I am a Canadian citizen but have been living in the United States for 28 continuous years lawfully due to parents who are US citizens. I have been on F-1 status recently that ended in February this year and I'm now in grace period until mid April 2025. When I leave for Canada before my grace period ends so that I don't accrue overstay days, how can I return to the United States for example to visit relatives again?
What complicates my situation is that my parents have filed I-130 for me and while in the US, I also filed
a still pending I-140 EB-2 National Interest Waiver. I don’t have approval for filing I-485 yet.
Additionally I have a E-2 treaty investor application pending.
I would like to know what are your recommendations for me to re-enter the United States?
-You may have trouble to reenter US as a visitor due to immigrant intent. But because it still takes a longer time for you to be qualified for the immigration, you might have a chance temporarily to visit your parents as a visitor. You also can enter US as E-2 investor after your investment program is approved. Just try and you never know.
