The UFT Enables DOE to Screw Members Yet Again

 Remember how Navin Johnson was so excited that the new phone books had arrived? I (and many others) wanted to have that same feeling when I awoke this morning. Today, after waiting since October would have had the remaining 50 percent of my retro. This is money owed us not just from October, but from
2009-2014. 

But alas, when you are really counting on something, something gets mucked up. And as usual the UFT is getting blamed. That could be debated. Hear me out. 

I do put the blame on the UFT for accepting the crappy 100 year schedule for our retro. I do put the blame on the UFT for not sharing with membership ahead of time that our October payment was to be delayed (They knew it several weeks ahead of time there would be an issue). I put the blame on not having the retro squarely on the DOE and the City for not making every single member whole today. 

I put the blame on the UFT for not only believing the bullshit reason why the checks didn't go in, but then  sharing the bullshit the DOE was spewing amongst membership.

The reason we were given was that the retro check was a "supplemental" check and not a payroll check. That this is why it would take banks longer for our direct deposit would be in our accounts. 

Which doesn't make sense.

How does a bank differentiate between a supplemental check and a regular payroll check? Money is money. If I went to the bank to deposit money into my son's account, would the bank know the difference if it was money owed for money for his birthday? Or spending money at college? Of course not. 

And if this DOE bullshit were true, why hasn't anyone seen their checks in the payroll portal? Do the banks have some magical ability to control the DOE's payroll portal? Doubtful. 

And we should trust the UFT when it comes to the upcoming change to Joe Namath's Medicare Advantage (Read more about this on Norm's blog and James Eterno's blog)? 

What would happen if a teacher who has yet to receive their retro today dies tonight? Would the teacher's family still be entitled to the retro check that should arrive tomorrow? Would the monies have to be returned? 

I appreciate that there were UFT higher ups that were proactive today on social media. In the past, it would not have happened. But Mulgrew should have been at the forefront of of speaking out. Imagine if this were the PBA. Pat Lynch would be having a conniption fit. 

But as usual, the UFT is the schlemiel (For those that are not up on their Yiddish, schlimazel is the person that spills the soup, a schlemeil is the putz the soup is spilled on.) of NYC labor unions. The City knows that it can't get over on the other unions. They know when they need to defecate on a union, on a union's membership they can turn to the us. The City know that its bullshit will be accepted. They City knows the leadership will rollover. That when the UFT screams, "Never again!" is just an empty threat and will be coming back with its tail between member's legs. 

I hope by the time I awake tomorrow morning member's will be made whole. I'm not betting on it.

Hey UFT, Show the Rank and File the Retro Arbitration Transcript!

 I am so not into today's Delegate Assembly. I usually sign up right away, but I am getting bored with the
same old same old. Besides I am kind of fed up.

Back in October's town hall, I asked a fairly innocuous  question...

"Is there a transcript of the arbitration hearing concerning our retro check and if so, when will it be made available to rank and file."

I received an email back from "John." In the email he shared with me that he is  following up with those that were involved and will get back to me. The email was sent on October 20. Today is December 16. 

I again asked the question at last month's town hall. As of today I did not get an email back.

I get it. I am not going to get picked to ask a question in a town hall or a DA? I don't genuflect. I am not a member of Unity. I am not a chapter leader. But at least have the decency to not only email me back but to answer my question honestly. 

So I am typing this and listening to the DA at the same time. I pressed zero as soon as I answered the call for the DA and spoke to Michael who took my question and was going to relay it. I am waiting.

What is the UFT hiding? If there isn't a transcript, let me know. If there is a transcript why can't I or any other member of the rank and see it? Doesn't the UFT wish for transparency? Transparency would easily do away with any rumors, innuendoes, and accusations that are going around concerning the leadership of the UFT. 

I'll make it easy for the UFT. I'll agree to go to a private room at 52 Broadway with other Unity people. Let me read the transcript without taking notes. Heck, I'll leave my phone at the security desk in the lobby. Better,  I'll strip down to my rather fashionable boxer briefs to assure there is no monkey business. 

If there is a transcript, I'd rather deal with the UFT in knowing if there is one and actually being able to read it. I guess the other method would be filing a FOIL request with the city and asking for it that way. I'm sure I can find someone, somewhere, in a different caucus other than Unity to file the FOIL request.

What's bothering me, what got me going about seeing the transcript is something Mulgrew said at the October DA which raised my eyebrow...

...and then on October 2 I asked for confirmation they were processing payment. Asked again.

 He knew something was up on October 2. Twelve days before we were told we would not be getting our retro monies on  October 15. There is no reason we could not have gotten a heads up sooner. This is what makes members question the UFT. This is what makes the rank and file nuts. 

By the way, the question portion of the DA has ended. My questions wasn't chosen. What a shocker.

Let's try this again. Is there or isn't there a transcript of the arbitration concerning the retro monies? A simple yes or no will suffice.

What is UFT Hiding in Not Releasing Retro Aribitration Transcript?

Tomorrow is a UFT Town Hall. I think these town halls show the UFT is being proactive somewhat and somewhat transparent. But how much of it is substance and how much of it is for show? 

Something like this should have been done a long, long time ago in a reality that was too far away. Mulgrew or whomever was UFT president should have had these town hall face to face in each borough every month. The ATR meetings in November I have appreciated but instead of once a year should have been every month. 

Each town hall I have pressed zero to ask a question. I used to get Rasheed, lately it seems like some retiree. It used to be that someone from the upper echelon of the UFT emailed you back. But that is if you weren't amongst the chosen to formally ask Mulgrew a question. No longer, now you get some anonymous hack emailing you back a question. One thing did improve, we don't hear the same Flat Stanley question time after time in a town hall.

My gut tells me the teachers that get to ask question publicly and their questions are pre-screened. It just makes sense. The numbers I have heard on a town hall phone call are over 10k. How is it that of all these town halls, all the pissed off teachers, all the thousands of teachers there has not been one teacher to dare question Mulgrew's leadership? To scream? To rant? To curse? To mock? Statistically, this is impossible. How many callers would call Mike Francesa to mock him and/or rant in just a single hour?

So last month I came up with a good question. It was about the arbitration hearing with our retro pay. I asked this question due to Mulgrew sharing this at last month's town hall...

Many of you have written me about it. We always anticipate bad things. We plan for bad days as teachers. Didn't talk to city about it at all, and then on October 2 I asked for confirmation they were processing payment. Asked again. I then called, knowing members would check paychecks.

 October 2nd he had a hunch what was going on. He could've shared this with us. He didn't. But, I thought, the arbitration meeting, it must've been transcribed. I asked (click to enlarge)...

I asked if there is a transcript of the arbitration hearing and if so when can the rank and file expect to see such transcript. The email I received was dated October 20, 2020, and I followed up on November 18, 2020. As of today, November 22, 2020, I have heard hide nor hair from the UFT concerning my transcript request. If there is a transcript, the DOE and/or the city must have said transcript. Perhaps a FOIL request can be filed? 

Transparency. That's not very much to ask for. Let's see the transcript. Why is it taking so long to respond whether or not a transcript exists? Or even just an audio recording of the arbitration. There is enough skepticism about the process last month with our retro. Prove the skeptics wrong. Release the audio and/or transcript of the arbitration. 

A lot of us got really screwed with half a retro check this year. I think it is only fitting that we know the full truth on how we are out half our retro.

The NYCDOE Has Stolen Retro Monies From Me and Other Teachers

I've Been laying low. Having to deal with Dr Evil and Mini-Me.

So, what's new? Tell you what's new from me. The DOE stole money from me, and it seems others as well. Not once but twice.

My son had saved up money to buy a car over the last six months. I promised him that I would kick in some cash towards the purchase but it would have to wait until the retro came in. When it came in, it was a real kick to the groin...





RESTR SETTL PR is probably "restructured settlement". But what is the PR?

Yeah, I am out $727.33. Why? A bit of a backstory first. I was under suspension when my the retro was dispersed. Last year when I got my first retro almost everyone else was getting there second retro check. As I was told, the checks are divided by 1/8, 1/7, and so on, or something like that. Anyway, the amount I received last year was equivalent to if it had been my second (Like everyone else) retro check. The amount I was blessed with this year is equivalent to what I would receive (which should have been my first) in 2015, which would have been less than last year's check. Therefore, last year I received more than I should have. So due to some bookkeeping method I am out over seven hundred dollars.

But if I received in the proper ordinal order...1st, 2nd, and so on, I never should have been out these monies. But looking at it with my non-mathematician mind, shouldn't the checks have the same total amount in whatever order they were dispersed? This seems like it is straight out of Abbott and Costello.

And guess what? I am not the only one this has happened to! I have heard from many teachers that feel that they have been robbed and want their money back. Like now!

My question is how do I, or those in the same predicament as I know that the numbers, or rather, the math is correct with what we are owed? Or for that matter what anyone is owed? Why has there not been something on the payroll portal a clear and concise accounting for each teacher, how much total money they are owed and the amount of each year's payout? This would solve so many problems and help teachers to plan accordingly.

Though the UFT has been quite helpful to me and has been on top of it, I've been cautioned that though I might get the seven hundred dollars back there is a chance that I might have it again deducted down the road.

That is why I filed a payroll grievance and hopefully I will not only get my money back but if and when it goes to arbitration it can be ruled that there will be no further deductions. Not to mention the hope, there will be accountability on the decision and the logic behind why I lost this money but a full accounting on how my retro is decided.

Fortunately, my son has a car. But not to soon after we had purchased the car, we learned that he needs a passenger side axle along with an inner tied rod.

The parts won't cost me much. I delivered auto parts during my suspension and can by the parts at the same price the garages pay (The mark up is obscene!). As for the labor, I know some good street mechanics in the Bronx and have a garage in White Plains that'll do the job for $200 (Gustavo's on Ferris Ave in White Plains---Shameless plug!).

"Not to worry," I told my son, "this can be fixed for on November 1 I shall be receiving yet another blessing from the DOE, my retro per session check."

"Oh blessed be Mayor de Blasio and Mike Mulgrew," my son said whilst smiling.

November 1 came. So did November 2. November 3. November 4. Nothing, nothing, and more nothing.

For some reason my per session retro is "not showing in the system." Why did this happen? No one knows. However, there is good news. I have been added to the list "of people who need to be paid." Let's see here. The definition of people is...
plural : human beings making up a group or assembly or linked by a common interest
The main takeaway from this definition is that people is plural. So ipso facto many a person (meaning many people) has yet to receive their retro per session.

I even called per session pay roll on Thursday. Iouldn't get an answer. What a surprise.

This is really from the files of "You Can't Make This Shit Up!" I'm out over $800. I am sure there are those that are worse off. But there is no transparency. No communication. No nothing.  

But UFT members have been in the dark since 2014 when this contract was ratified and we were told it will take until 2020 (And myself and others in 2021) to be made financially whole again. I want my money.  Maybe I will have it in time for Hanukkah. In 2020.

Mazel Tov UFT!!

A hearty handshake is extended from us here at SBSB to our leadership at the UFT for not only being at the forefront, but for having the foresight, to not only oppose Proposition 1 in this past Tuesday's statewide vote, but also in the defeat of the aforementioned proposition. Kudos!

Not only that, the UFT is publicly preening itself in self-adulation as a teenage boy who has lost his virginity in playing its part. Yes, the emails, the phone calls, the robo-calls, and even the text messages from real people got 82% of voters to say heck no to Prop 1.

Just how much is the UFT kvelling in it's unprecedented "win?" Let's just look at Facebook...

So here is what I, and I am sure many others want to know. Why can't the UFT put the same time and effort in for its members that it does for defeating a NYS Constitutional Convention?

Why can't the UFT put the time and effort into doing away with the fair student funding which is keeping many qualified teachers from permanent positions?

Why can't the UFT put the time and effort into fixing the ATR problem?

Why can't the UFT put the time and effort into exposing abusive principals?

Why can't the UFT put the time and effort into make our union a true democratic union in which different ideas are debated and respected?

Why can't the UFT put the time and effort into enforcing our collectively bargained contract?

Why can't the UFT put the time and effort into ensuring that every member, whether active or inactive gets every last cent due them of monies owed since 2009, regardless on how one left the DOE?

Why can't the UFT put the time and effort to have ensured that we all get our retro in one sum, in 2015, instead of waiting until 2020 or 2021, both over a decade from when we should have had a contract and a raise.

Why can't the UFT put the time and effort into just doing the right thing? Really? Is it that difficult?

My dad used to tell me you can do anything you want when you decide to put your mind to it. Maybe the UFT should listen to what my dad had to say.

Thank You UFT, May I Have Another?

It's been some time since I took the UFT and it's "leadership" to task, but now is as good as time as any.

I was looking forward (As are all of us) to my retro pay coming up in a few weeks. Even better, I was going to get a double retro check due to me being suspended (But technically "on leave") when teachers got their first checks in October 2015.

I was told, specifically, by several within the UFT that I was to get TWO payments with the upcoming retro check. Yes, more taxes will be taken out, but a double check would be nice.

So about last week I was reading Arthur Goldstein's blog and saw something that raised an eyebrow. Those who were on leave or whatever in October 2015 will not be getting a double check.

I checked with a good person within the UFT and I received confirmation.

Then a few days later Chaz the Blogger called me up to share the news.

Then I told my wife. YIKES!

Yeah, it is true. Anyone considered on leave when the first retro checks came out in 2015 this year's check will be considered their first payment and next years the 2nd and so on and those of us affected by this inanity will have to wait until October 2021 to be made full.

According to my sources the UFT never shared this part of the agreement with the rank and file. It is deeply embedded in some super duper double secret part of the MOU.

The UFT does it to us again. Just for the f*&*ing seat at the table. Just to f*&*ing acquiesce to the f*&*ing city once again.

"NO! You can't get your retro all at once, we might bankrupt the city. There are too many UFT members. You are not entitled to retro," goes the gibberish from 52 Broadway.

BULLSHIT!!!!

It takes two parties to agree to no retro. It takes one party to cower like a scared UFT President Dunsel to give into the city this f*&*ing ridiculous, moronic retro schedule!

DC 37 has as many members if not more than the UFT and they got their retro checks in one lump sum. So did the cops, the firefighters, the sanitation workers, the shit cleaners, and everyone except the UFT thanks to President Dunsel.

Who the f*&* came up with this idea of paying us over the course of 5 years? And worse, if you are terminated, quit, or die you get nothing! Bupkus! You are then royally f*&*ed!

So come 2021 when I get that last check, my son will be starting his junior year in college, the Jets will still be without a quarterback (I'm not a Jets fan), mass murders will increase, Trump will be in a mental hospital, and the UFT offices, thanks to Janus, will be down to a 250 sq ft office storefront. Now located next to Sizzler's on Tremont Ave in the Bronx with President Dunsel sitting a high school desk.

I swear when I tell friends who are members of other unions how the UFT operates they just don't believe it. This shit can't be made up!

It is time, with Janus on the horizon, that the UFT starts to heed the wants and needs of the rank and file.
