Has the MORE UFT Caucus Run Afoul of the IRS?

 Is MORE, the Movement of Rank and File Educators, committing tax fraud? This question has been put to The Crack Team. Since The Crack Team are neither accountants or nor tax specialists we can't make a final determination. The Crack Team can only present what they have uncovered and let you, the reader, make your own inferences. This investigation was spurred by several disenchanted MORE members who asked that this accusation be looked into. 

The Crack Team is in possession of MORE's most recent 990EZ filing (2023). This form lists the cash MORE had at hand at the end of 2023, it's officers, and monies spent. But there is more, which can seems to be more interesting. 

But there is something more (pun intended) interesting. On the IRS website it lists that MORE has had their tax exempt status revoked on June 15, 2022. 


Apparently, at the time, MORE had not filed for three straight years. In fact, only the 2023 and 2021 returns are available. But if you notice MORE is a 501(c)(4) organization. But more (pun intended) on that in a moment. 

In a letter dates May 25, 2023 the IRS states...

We're pleased to tell you we determined you're exempt from federal income tax under Internal Revenue Code(IRC) Section 501(c)(5). This letter could help resolve questions on your exempt status.Please keep it fr your records.

So it would be safe to assume that MORE presently has all it's ducks in a row. But does it?

What is a 501(c)(5)? Let's find out.

Section 501(c)(5) provides for exemption of labor, agricultural or horticultural organizations. To be exempt, an organization must meet the following requirements: The net earnings of the organization may not inure to the benefit of any member; and The objects of the organization must be the betterment of conditions of those engaged in the pursuits of labor, agriculture, or horticulture, the improvement of the grade of their products, and the development of a higher degree of efficiency in their respective occupations.

But this definition begs the question. How does MORE's anti-Israel, borderline anti-Semitic actions better the pursuits of labor? Remember this blog post? Is this for the betterment of labor? Does Alex Jallot work towards the betterment of labor?

Do these anti-Israel, borderline anti-Semitic activities that MORE attached their name and logo as well appear to be for the betterment of labor?



Again, The Crack Team are neither accountants nor tax specialists. Not even IRS agents. But to the lay person, one mights infer that MORE, at the very least, but not be following the spirit of 501(c)(5), and at the worst, be breaking the law. But those are questions for bigger and better people.

Apologies to Dan Alicea

I want to truly apologize to Daniel Alicea. On November 30, Dan wrote a blog post about how, despite millions of dollars being available, Mulgrew refused to address the pay issues for paraprofessionals.Naively, in retrospect, I asked Daniel a question in the comments section. I quote:

"Dan, what is your plan. What would you do?"

I wasn’t trying to be snarky or troll him—I was just asking a simple question.

Dan, to his credit was quite polite and responded with...

"Hi Pete, as I indicated prior in my post I will share some ideas (about 5 or 6) in an upcoming post shortly and would love to crowdsource others like yourself...We must to find those opportunities in the next round… which happen in most negotiations …and next time go in intentionally and decidedly knowing those extra monies will be added to increases for hard to staff positions like paras."

Thank you Dan, for the response. 

But now for my apology. The other day on Facebook, I again inquired of Dan, "Where is your plan?" (Hey, that rhymes!) I reminded him that he had promised a plan. I was wrong. Dan never promised a plan. For that, I apologize. He is correct, and I was incorrect.

Dan also reminded me of how busy he is—teaching four different subjects a day, running an ICT class with several paras, editing his award-winning radio show on left-wing WBAI, and even cooking dinner.

Again Dan, I apologize. I did not know that you led such a busy life. It's a good thing that all those activities don't take away the memes, the posts, etc... on Facebook. 

At least Dan didn’t pull a Trump and claim to have a “semblance” of a plan. But I’m still confused.

There must be ideas floating around inside Dan’s head. Is this the plan?

...and next time go in intentionally and decidedly knowing those extra monies will be added to increases for hard to staff positions like paras.

If that’s it, Captain Obvious might say, "Hey, who’d have thunk of that!"

Now, please don’t misunderstand me—I am not disparaging paras. They deserve better pay and much more respect. I’ve worked with some incredible paras. They work tirelessly, and those in District 75 especially should be paid even more. I say, give them a living wage. But how will that be done? What will be done differently than what Unity has been doing?

The UFT has been making strides. but there’s one issue Dan has been silent on: the problem of sub-paras who remain in those positions for far too long. If you look at the excessed teacher website, there are countless paraprofessional vacancies—it’s mind-boggling. At schools I’ve been to, I’ve seen paras who have been sub-paras for years. Why? Because administrators get away with it.

Being a sub-para means you don’t get paid for sick days or personal days. You don’t get paid when school is not in session. You don’t get paid during the summer. You don’t receive Welfare Fund benefits or health insurance. So, yes, let’s fix para pay. But what about the hundreds, if not thousands, of paras still deemed sub-paras?

Why isn’t Dan pounding the drums for this? Wouldn’t addressing this also raise the average pay for paras?

But to advocate solely for increased pay? There has to be a reason. It feels like a divide-and-conquer strategy—us vs. them.

As one SBSB fan wrote in an email to The Crack Team:

Dan is saying that money should not have gone to teachers and should have gone to paras. This is yet another attempt by the very toxic and extreme left within our union to get members (in this case to get paras and teachers) to trust each other just a little less than they did the day before. It is the same lame divide and conquer approach to organizing that has failed them and us for over 40 years now.

The fanboi goes on about Dan's math...

Do you remember the “signing bonus” and the “retention bonus” from the last contract? What this says is that the money that was used to fund those bonuses was new money that was brought forth by New York City. This is actually important because sure literally all money for city contracts is set aside from each budget year and it is all accounted for. But for this bonus money, the city just pulled it out on the table. What this says is that that bonus money  -the money teachers get for bonuses- could have or should have been used to increase para pay.

But that is jut one fanboi's position, not mine. Just felt I needed to share it and present all sides. 

So, what about that plan? I apologize for assuming you had a plan. I apologize if you think I ask “gotcha” questions. But it’s only a gotcha if you don’t have a plan or lack confidence in your plan or yourself.

I’m sorry for responding to you on Facebook. I thought you could take it. God knows the abuse I’ve taken over the years in the comments on this blog. I was wrong. I apologize.

Lying Liars of the NYC DOE

 The APPR travails continue. 

When last I blogged I shared how my principal, XXXXXXXX XXXXX of PS XXX did an end run around me. I was refused to be observed and rated through Advance. But, however, thanks thus for to the
Bronx UFT this case shan't wither away. We will have a step 1 hearing come September and I am sure this will go further. That is in addition to the appeal for the bogus U rating I received. 

But I believe in getting all the information possible. And apparently others do as well. In my blog post of June 29 I posted just a memo with the agreement to Advance, who will be under it, etc... But it is just a memo. Or whatever. How much juice would it have?

Blogger NYCDOENUTS contacted me last week and suggested I look to the contract. OK. I looked. In Section 8J Part D Covered employees, Section 2 it states...

Same words, but in the contract. But codified. In the contract. But yet another method that our administrators pay no heed to the contract, to a legal agreement. Just because they feel they are above the law. McDonald's managers are more honorable. 

Thank you DOENUTS! You're a mensch.

So during one of my conversations with Principal XXXXXXXX XXXXX of PS XXX I was told; 

"I am not sure if you are on Advance. I will have to check."

I made this inquiry in February regarding my IPC. Wouldn't a principal be aware of this without having to check? A manager at McDonald's would know who is qualified to perform each task (I in no way am belittling working at McDonald's. I worked at McD's myself in 1980). 

But someone, way, way up in the NYCDOE got in touch with The Crack Team concerning how one gets on or off of Advance.

"Your principal has the ability to make teachers eligible or ineligible based on the eligibility requirements listed here (section 1.1.1)" (Remember, the above mentioned memo)

So why would Principal XXXXXXXX XXXXX of PS XXX be uncertain whether or not I was in Advance? According to information received by The Crack Team it is the principal that determines whether or not one is on Advance

Is it possible I was on Advance and when I started asking for an IPC Principal XXXXXXXX XXXXX of PS XXX summarily removed me? I mean it was February, who asks to be observed, especially APPR observation? I am sure it was common knowledge. Advance was advantageous to me and other teachers, in particular ATRs that got a bogus letter to their files. 

Even if the new contract is ratified, the unchecked, unfettered abuse by administrators will continue unabated.

Mike Mulgrew Pulls a Dwight Schrute

 Sometime ago The Crack Team secretly embedded a microphone on Mike Mulgrew to get a first hand account of healthcare negotiations, meetings with members, and other inanity. This microphone was with Mulgrew for over a year. Unfortunately, members of The Crack Team were unable to upload the original recording due to a technical glitch. But when one door closes another door opens. Frank of The Crack Team had the foresight to transcribe the year long audio and tonight, for the first time anywhere, SBSB takes it's readers deep into Mike Mulgrew's plan to subvert our healthcare. 

Mayor Adams: There’s a decision that needs to be made, and I’m having an unbelievably a busy day. So I’m going to let you pick a health care plan for our NYC retirees and then explain it to the retirees

Mike Mulgrew: Yes. I can do it. I’m your man..

Mike Mulgrew: OK, first, let’s go over some parameters. How teachers can I fire?

Mayor Adams: Ah, none. You’re picking a health care plan.

Mayor Adams: If Mulgrew fails, then that is strike two, and good for me for, ah, for giving him a second chance. And if he succeeds, then, you know, no one will be prouder than I am. I groomed him. I made him what he is today. Unless he fails, and we’ve talked about that already.

Mike Mulgrew: What did I do? I did my job. I slashed benefits to the bone. I saved the city money. Was I too harsh? Maybe. I don’t believe in coddling people.

Mike Mulgrew: In the wild, there is no health care. In the wild, health care is, “Ow, I hurt my leg. I can’t run. A lion eats me and I’m dead.” Well, I’m not dead. I’m the lion. You’re dead.

Female UFT Officer: OK. Mike. Are you really in charge of picking the health care plan?

Mike Mulgrew: Yes. And my decision in final.

Female UFT Officer: This is a ridiculously awful plan. Because you cut everything.

Mike Mulgrew: Aww, times are tough. Deal with it.

Female UFT Officer: You cut more than you had to, didn’t you?

Mike Mulgrew: Sure.

Female UFT Officer: Well, why did you do that? You work for the DOE as well, don’t you want good insurance?

Mike Mulgrew: Don’t need it. Never been sick. Perfect immune system.

AT A TOWN HALL MEETING OVER ZOOM IN 2022.....

Mike Mulgrew: OK, everyone. Gather round. It has been brought to my attention that some of you are unhappy with my plan. So what I’d like you to do is to open chat windows and type down any diseases you have that you might want covered and I’ll see what I can do.

Two Teachers Collaborating during town hall meeting...

Teacher 1: So, let’s say my teeth turn to liquid and then, they drip down the back of my throat. What would you call that?

Teacher 2: I thought you said you were inventing diseases? That’s spontaneous dental hydroplosion.

Mike Mulgrew: Uh, someone forged, uh, medical information and that is a felony. Uh, leprosy? Flesh eating bacteria. Hot-dog fingers. Government-created killer nanorobot infection. I’ll have to interview each and every one of you until the perpetrator makes him or herself known. And until that time, there will be no health care coverage for any one!

The problem, is that people who are really suffering from a medical condition won’t receive the care they need, because someone in this office is coming up with all this ridiculous stuff. [reads off of paper] “Count Choculitis”

At a town hall meeting several weeks later....

Mike Mulgrew: I’m now going to read out loud your submitted medical conditions. When you hear yours read, please raise your hand to indicate that it is real. If you do not raise your hand, it will not be covered. Number one: Inverted penis.

Mike Mulgrew: OK, great. Dermatitis. Thank you. I’ll make sure that’s covered. OK, now. Who wrote this, hysterical one? Anal fissures?

Teacher from Staten Island: That’s a real thing.

Mike Mulgrew: Yeah, but no one here has it.

Teacher from Staten Island: Someone has it.

EXCLUSIVE!! FIRST TIME PUBLICLY! Civil Complaint Against District 7 Superintendent Roberto Padilla

Back on July 3, 2022, I introduced to those who read this blog the new
superintendent and overlord of District 7, Roberto Padilla. Just last week, the rather "everything the DOE does is good" New York Post ran this story . The Post was inquiring on why a man with such a checkered past was hired as a superintendent. Soon, The Crack Team got cracking. 

The Crack Team at SBSB has received a copy of the complaint filed against new District 7 superintendent Roberto Padilla and the Newburgh Enlarged City School District. Click this link to read the entire complaint. 

But some highlights, or rather, the lowlights, of the complaint will be shared and deciphered here. But let's set the scene from the complaint...

In or about early June 2021, Defendant Padilla sent out a District wide announcement encouraging all administrators and teachers to attend ASU+GSV Summit (the "Conference"), scheduled for August 9 to 11, 2021 in San Diego. In an email from Defendant Padilla's office to the District advertising the Conference, it was described as, "one of the premier learning summits in the country," stating that applications were handled on a first come, first served basis. Plaintiffs separately submitted an interest form, each explaining how the Conference aligned with their school's goals and instructional focus, and why their attendance would add value to Newburgh.
So let's get this straight. The poverty level in Newburgh is at or below 84.5 percent. There is practically no tax base in Newburgh. Yet, a conference in sunny, oceanfront San Diego is a priority? This reminds me of how in the 90's District 7 went to some conference in Hawaii. 
Plaintiffs both were selected to attend the Conference, and submitted the conference costs of $3,000 which were covered by Newburgh, through their budgets. 32. Upon information and belief, approximately seven (7) District employees attended the Conference. Some of those who attended were also old friends of Defendant Padilla. 33. Upon information and belief, most of the Newburgh attendees stayed at the hotel designated for the Conference, the Marriott Marquis hotel, while Defendant Padilla stayed at a different hotel
Three thousand times 7 people attending is $21k. Did that include meals and the stay at the exclusive Marriott Marquis

But here comes something strange...
Plaintiffs received very little communication from Newburgh about what they could expect at the Conference, and the objectives of their attendance for Newburgh. There was no orientation for the Newburgh attendees, and no conversation about how to make the most out of their attendance by, for example, planning who would attend which of the over forty (40) daily events offered at the Conference. Plaintiffs were discouraged by the lack of interest in the Conference demonstrated by Defendant Padilla before and during the event
Was this a true trip for educational purposes or was it just an excuse to spend other people's money and/or do some skirt chasing? 
The night of August 8th, Plaintiffs arrived at a Brazilian steakhouse in San Diego's Gas Light District asking for "AJ," since Defendant Padilla told them the reservation was under that name. At the restaurant, Plaintiffs were surprised to find that "AJ" was the CEO of Innovare, an Ed Tech company that named Defendant Padilla to its Advisory Board in March 2021, and was planning to work with the District. Plaintiffs were confused that Innovare was hosting their group for dinner, and did not understand what connection Innovare had to Newburgh. It appeared as though Defendant Padilla had a close relationship with the Company, but no explanation was provided to the Newburgh group about Innovare's offerings, or why they were being taken to dinner by the Company
Innovare is an app that according to its website, "empowers education leaders to make data-driven decisions that positively impact students and communities." "AJ" is Adrian DeLeon, founder and CEO of Innovare. 

Several takeaways here. Should Roberto Padilla be on an advisory board that the Newburgh schools might be doing business with? And who paid for this dinner? If it was AJ is this permissible under NYS law? And if there were to be some business done between Innovare and Newburgh would it not be more feasible and ethical for Innovare to come to Newburgh? AJ could have splurged at the Denny's on Route 300 instead of the big bucks at the steakhouse. 
The following night, August 9, 2021, the Newburgh attendees gathered at a restaurant where Defendant Padilla had told them to meet. Once there, they were surprised to find that this dinner was sponsored by Rethink Ed, another Ed Tech company. 44. Diana Frezza, an Executive Vice President at Rethink Ed, was ordering food and buckets of sangria for the Newburgh team. Plaintiffs engaged her in conversation and learned who she was, but not why Newburgh was being taken out to dinner. At the end of the dinner, Plaintiffs returned to their hotel.
Drinking with subordinates is never a good idea. People can get stupid. 

So let's turn our attention to some of the proclivities that Roberto Padilla has with women. 
XXXX was sitting on a couch alone when Defendant Padilla sat down right next to her, despite there being other seats available. Defendant Padilla sat on her right side, putting his arm around XXXX, and rubbing his knee against her knee. Padilla had been drinking whiskey cocktails throughout the evening. He appeared intoxicated and was touching her inappropriately. XXXX felt uncomfortable and scared. 
Not cool. One is a supervisor, the other person, a subordinate. Fraternizing with your subordinates is not good and if it has to happen being infused with alcohol is not a good idea. And geez, what is wrong with just having a beer or two? 
Defendant Padilla appeared to grow increasingly intoxicated as the evening continued. Defendant Padilla began commenting on the couple (a male and female) romantically sitting on the couch across from them, stating "we're going to be sociologists." Padilla commented that he and XXXXX were "cock blocking" the couple, meaning their presence was preventing the couple from engaging in sexual activity. Padilla then went on to make sexually explicit noises, orating "a little radio show," creating his own description of the couple's public displays of affection. Padilla then began hypothesizing as to the likelihood that the man would "get lucky" that night.
Defendant Padilla scooted his body towards the front of the couch so his foot was touching Plaintiff XXXXXX's foot. Defendant Padilla then began running his foot across Plaintiff XXXXXX's foot. Plaintiff XXXXXXs legs were crossed at the knee, and Defendant Padilla kicked her foot which made her legs uncross. Plaintiff XXXXXXwas aghast, realizing that her boss was suggestively touching her. 

Defendant Padilla then started talking about XXXXX's tattoo, and he touched her back, slowly tracing his finger over the image of a bird that is part of the tattoo, commenting on the birds "big red ass." 56. XXXX was horrified by Defendant Padilla's comment and by his inappropriate touching of her back. The bottom of the bird in XXXXX's tattoo was not visible, and the bird is dark grey, not red.
And this is the man that is to lead the students, the community, and the teachers of District 7? A man that has no qualms about acting inappropriately with female subordinates. A man who can not control his drinking? A man that appears to have no ethical standards either with subordinates or companies that Newburgh schools do business with? 

Can the the stakeholders of District 7 expect the kind of hijinks that Roberto Padilla exhibited in San Diego? My son is in a frat and everything I just read in the complaint seems right out of a frat house full of twenty somethings. 

District 7 deserves way better.

Unity Members and Supporters Seem to be Splitting Ballots!

Yes, the ballots are out. I got my ballot in the mail on Monday. Simple for me. I am voting the UFC slate. No vote splitting for me. In 2019 I did not vote slate and vote for both Solidarity candidates and deserved candidates from Unity. In fact Chaz the Blogger was known to do this (here and here). Even NYCDOEnuts is doing so this year (here and here). I disagreed with them but as those who knew Chaz and know NYCDOEnuts know both men of their convictions. 

But something is amiss out there. Word has been filtering into the SBSB news room as well as to members of The Crack Team that a another form of ballot splitting occuring. Which can be quite ominous for the Unity ticket.

From what we here have heard is that many members of Unity are fed up with Mulgrew. That this year nstead of voting for the Unity slate,  these people with be voting  Camille Eterno for president and voting for the rest of Unity. 

Of course this is anecdotal, and some of it has come to us as second hand. But where there is smoke there is fire. So far in this election cycle we are seeing things never before seen from Unity. There have been attacks upon the opposition on Twitter and a professionally created web page. We have seen talking points and slogans that seem to have originated with focus groups and let's not forget one more thing; The smell of real fear coming from Unity. 

Now of course we don't know how many in Unity are ballot splitting. We don't know if those that are taking this path are "official" members of Unity or just regular rank and file teachers like you and me. Heck, we don't even know if its a few dozen or so who are doing this or if there are hundreds. There is no way to know. But what we do know this years election cycle is different than in years past. 

What does this say about Unity if that many are fed up with Mulgrew? Look long term. The worst thing for Unity would not be for it to lose the election, but to get under sixty percent of the vote. At least a total lost there probably will be people willing to fall upon there swords and have the foresight to reform the caucus. But if Unity stays in control and loses a significant percentage of votes the bloodletting can and will begin. It's time for the Unity house of cards to have some damage.

UFT Unity The Smell of Fear

 Smell that? It's fear. Desperation. It's exuding from 52 Broadway.

This is my fifth go round of being involved one way or the other with these union elections. What I've seen from the UFT Unity caucus this year is unprecedented.


The Crack Team assembled this afternoon to see if my hypothesis is correct. They crunched the data and looked back at the last two election cycles, 2016 and 2019, to use as a control group. They decided not to use 2010 because it was too far back and social media was still in its infancy and 2013 was excluded due to it being MORE was still in its infancy (I'm not trying to disparage MORE here, in fact I forget if MORE ran anyone in this election).

If we look at 2016 MORE was building up steam and was well organized. But there was also Solidarity which, if memory serves, was running in its first election. 

Both opposition groups were pretty much at loggerheads then and one could reasonably say they split ticket, however MORE did win the high school seats. But, could be seen as a wake up call for UFT Unity, but it wasn't. In the past, the opposition had won high school seats and in my opinion UFT Unity just dealt with it.

In 2019, was a real hullabaloo. MORE was in disarray and not really trying (Again, I am not disparaging MORE) and Solidarity was trying to pick up the pieces from... how do I say this? Shit happening. Yet, with all this Solidarity made a surprise second place showing. 

So this is the extreme brief take as well as history on the previous two elections. I am sure there are many who can fill in the missing pieces in the comments section and I welcome them to.

Social media started to "take off" as well in the previous two elections. Even on the UFT Unity side. The Crack Team did a search on Twitter for January 1-May 15 for both years. In both those election cycles the UFT Unity Twitter account was basically used to tout Unity and to get out the vote (Click here and here for search of UFT Unity tweets for those years). As you can see, nothing even mentioning opposition groups. 

This year, things apparently have changed. The UFT Unity twitter account seems to be mirroring the same type of tweets by United for Change in which executive board members and other candidates are introduced. Usage of Unity's "blog" and/or website to dig at the opposition. Mayhem at the Delegate Assemblies. UFT officers attacking the rank and file. Claiming others are not doing the work when others are not in power to. 

Even a plethora of disingenuous blog posts.

Why is UFT Unity running scared? Two reasons I have noticed. 

Anecdotally, in speaking with in service members I personally (Again this is from my personal experience. There is nothing scientific about this data ) am hearing from many disaffected members of the rank and file. Members are done with the lack of leadership from COVID, to constant abuse by administrators, to bogus AARP ratings, to justs a general mistrust of the union leadership in particular how out of touch Mike Mulgrew is. 

But that is not UFT Unity's biggest problem. Like a boil on the buttocks of the UFT that needs to be either lanced or popped the faction that was most loyal and actually votes is fed up. Care to guess? 

The retirees.

How the gosh darn does one turn against their most loyal votes as Mulgrew has by shoving Medicare (Dis)Advantage down retirees throats? Where is the logic? Why is this done without ANY input from retirees? Why is this done with nothing but, "Trust us, it'll be great," when there is nothing but a blank paper to show?

How can Mulgrew force retirees into Medicare (Dis)Advantage buy claiming, "You will be able to continue with your own medical providers," when there is no list of doctors, therapists, hospitals, that are on the plan! How does this make any sense? 

What does Mulgrew have to say to an 85 year old retiree who lives on a fixed income, as several medical ailments and is being forced to choose between Medicare (Dis)Advantage in which the retiree has no idea what to expect or paying $190 a month to keep their Medicare.

Yeah, I know a judge just sided with the retirees. But does anyone really trust Mulgrew? I know I don't. 

UFT Unity is in a lose lose situation. If the percentage of their vote dips below 65 percent there will be a bloodletting in Unity and if not we will have a hobbled union when contract negotiations start in earnest.

Mike Mulgrew Folds Like a Cheap Suit For Eric Adams and a Mayor Who is Gone in Three Days

First kudos to Mike Mulgrew. He knows when to talk a tough game as he did on NY1 last week. Yeah, he shows he is "there for the members," that he actually his doing something. But as usual, he folds like a cheap suit from the Johnny Carson Collection that used to be sold exclusively by Sears. 

I was driving over the Tappan Zee Bridge this afternoon when I heard word of the latest failing by Mulgrew. I shook my head and contemplated driving into the Hudson River. I thought better that I control the means of my demise rather than my union that is supposed to protect all its members in the schools and me. However, I changed my mind. I mean, who then would be able to blog about this complete and utter shirking of leadership and responsibility?

Not me. I can't do this. This plan, that I heard over WCBS 880 and later read in a personalized email sent by our leader, has so many obvious flaws and leaves so many questions unanswered. I was aghast and just speechless. The Crack Team and I have decided to ask my neighbor's 8 year old son Timmy to rebuke Mulgrew. Take it away Timmy. 

The staff of the Situation Room will double in size, making it bigger than ever before and able to handle the current surge.

Bigger doesn't mean better. How long will it take to get to the numbers that will make the Situation Room effective? What are the qualifications to be employed by the Situation Room? What is the pay? Are Situation Room employees employed by the DOE are by outside contractors? Who is in charge of the Situation Room? Are there any medical doctors employed? Consulted with? Shouldn't the UFT President Mike Mulgrew share this with the rank and file? 

The city will double in-school PCR testing in every school every week. These tests will now include both vaccinated and unvaccinated students as well as staff. The city will make another push to get parents to consent for their child to be tested regardless of vaccination status.

Big deal! Will this be testing anybody, anytime? Why test every other week? What happens if the shit hits the fan (My daddy says this all the time!)when during a week of non testing? Will teachers be allowed to be tested whenever? Will students be mandated to be tested without a parents permission?  Details please, Mike Mulgrew!

Close contacts and classmates of positive cases will now have immediate access to two at-home rapid tests that they can take to monitor themselves for the days after exposure. 

This has so many flaws that I can't believe that I, just a child of 8, can see this, but Dear Leader Mike Mulgrew can't.  

Schools reopen January 3 inn a city where their are shortages of materials and every conceivable item for teachers and students. Why should we believe that next Monday there will be over 1 million test kits available for every student and employee in DOE? 

Who and what determines a close contact? Read what Pete wrote on Sunday. What happens if there is a false negative? How does one know if there is a false negative? Are schools to rely on the honor system of parents? Can you imagine if a student tests positive and yet is asymptomatic? Is it possible that a parent will not keep the child home but rather send the child to school? What if there is a choice between work and keeping a child home? What if the parent loses the test kit? 

But I keep coming back to this being a logistics issue. The DOE can't be trusted to do jack. How can the DOE be trusted to keep its word not only on getting test kits to everyone?  And at the same time keep its word on the Situation Room and the in school testing? 

There you have it. Timmy the 8 year old is able to take apart the agreement Mulgrew agreed to with the city. Let's look at the rest of Mulgrews email.

Bullocks. We are not working together nor Mulgrew for us. Mulgrew has a flush and is folding to de Blasio, Hochul, and Adams who each are holding just a pair. Besides, how can it be us when not one working stiff teacher has been consulted? 

We, as educators, are always prepared to do our jobs.

We are, Mulgrew still isn't.

The real issue is whether the city can do its job — ensuring that ample testing is available in every school and an improved Situation Room is actually in place by next week.

Timmy addressed these issues. He knows the real deal. Mulgrew doesn't.

It's Official: The UFT Does Not Give a Shit and Mike Mulgrew is the Grim Reaper

 Who remembers Trixie the teacher? For those who don't remember, Trixie was the teacher that had sanitizer splashed in her eye and is teaching nuclear fission for grades K-2 without any coaching or anything from higher ups. Caught up? Good. Because the news gets nuttier. In fact so nutty, the news falls under the auspices of "This Shit Can't Be Made Up!"

Trixie teaches at the Speed Racer School. It is a K-5 school with a lot of students and teachers in the building. Whilst out caroling on Thursday with other teachers from her school Trixie found out news that made her so aghast, so upset that she puked.

For several days of last week (The days before break), an entire grade at the Speed Racer School was on quarantine. That includes the students, the teachers, the paras, and any wayward cucarachas. All students and their families, the teachers, the paras, and any wayward cucarachas were all notified. 

NOBODY ELSE IN THE SCHOOL WAS NOTIFIED!

No, I am not making this up. 

"B-b-b-ut we did contact tracing," Trixie was told.

Yes Trixie was told that. But is contact tracing 100% effective? What happens if someone doesn't remember being near someone. Or someone is in the stall going #2 and someone else is at the urinal going #1? They are both in the same bathroom. How would the those at the stall and the urinal know who is in the bathroom with them? 

How would someone remember if they were just passing someone in the hallway? Or on the stairs? Or sitting together in the auditorium? Or, outside the building walking in?

Trixie is freaking out! She has health issues to begin with. But there are loved ones at home who are seriously immune-compromised.  Yes, Trixie and her loved ones are all vaccinated as well as having had boosters. But there is nothing guaranteed in this world except death and taxes.Wait, there is one more thing that is guaranteed: Mulgrew and the UFT leading from behind and not being proactive!

I'm not giving Mulgrew or the UFT and thumbs up, kudos, or job well done for last weeks email and presentation on NY1. It's all to little too late.

As much as a loath PBA President Patrick Lynch he would have the balls to tell his members to stay home. 

Trixie shouldn't be upset with her school administration. She should be upset with the DOE, the Situation  Room and the UFT.

But, the DOE and the Situation Room is not there for the teachers well being. They are not supposed to give a damn about us. However, at the very least the UFT is, at the very least, supposed to feign interest in its members well being. 

When Trixie came and shared this story with myself and The Crack Team we sat there incredulous. Yes, none of us expected the DOE to do anything? But the silence coming from the UFT on  this quarantine has been deafening as well as mind numbing. Of course the UFT knows about this shut down! How couldn't they? Why didn't the UFT notify the members of Trixie's school? And by the UFT, we want to know why 52 Broadway was silent, not the borough office. This falls upon those downtown to make sure are mitigation is being done right, to ensure there is social distancing, mask wearing, etc.. and to inform and allay concerns of the members as well as the parents. And what happens? NOTHING! BUPKUS! STUGOTS!

A kid with head lice or strep throat a note goes home. Head lice or strep are easily treatable and cured. COVID and Omicron it's "If we don't say it out loud or if we bury our head in the sand it'll go away."

How difficult is it for the UFT to lead?

What United for Change Must Do When and If They Win

 It's December. The ballots for the upcoming UFT election will be sent out in April (Maybe this will be when we get our 2020 spring break pay?). Anecdotally The Crack Team is hearing many more rumblings and anti-Mulgrew fervor than in past elections. This could be a sign. The coalition needs to be ready. If
and when there is a changeover, there needs to be a plan.

The Crack Team and myself have spent the better part of today spitballing some ideas on how the coalition can show how it will be a true union, how it will be there for the rank and file, and how the UFT will governed and run for and by the rank and file. 

1. 100% Openness 

Can you imagine not watching Congress on C-Span? Not watching your local village, town, or city government on your local cable access channel? You can't. But if you are not a UFT delegate you are shit out of luck. Unless you schlep to 52 Broadway and watch a grainy feed on TV in a little cold room. 

In this day and age there is ZERO REASON for the UFT Delegate Assembly to be held in secret. The first thing the new ruling coalition must do is make the DA accessible for all! Live stream it across several platforms. Have the minutes of all DA's posted, as well as archived, on the UFT website as soon as possible.The same goes with the executive board. In fact, those who need to speak before the exec board should not be forced to come into lower Manhattan. Speakers can easily participate thorough video or streaming. Heck, even an email can be read into the record. 

Remember, a more participatory union is a STRONGER union. 

2. Voting

All voting at the DA and exec board will be done using technology. A simple add on to the UFT app will back this possible. We here at SBSB are darn sure there is enough bandwidth to go around at 52 Broadway to go around.

The same goes for union wide elections. There is no reason that union wide elections can't be done from one's UFT app or on the website. Mulgrew blustered at the DA on Monday about electronic balloting...

Electronic voting sounds great but how do we make sure it survives challenge. NLRB has frowned upon this. 

Yeah. Sure. Right.  Please if the UFT wanted to it could and would.

3. Avoid Cleaning House for the Sake of It

There are a lot of good, strong people working in the borough offices and at 52 Broadway. Find these people. Keep these people. 

4. Vote on Everything

Any change to the contract or to working conditions or if the DOE wishes to give us Zwieback in the morning it must be voted on by the entire rank and file and not approved by a few people. It's that simple. 

5. District and Borough Reps Must Be Elected

This goes without saying. The question is who does the electing? The chapter leaders are all members? 

6. Travel

There is one DA a month plus two exec board meetings a month. Why must both be limited to Lower Manhattan. Take the show out on the road. Why? Because participation is a good thing.

7. No Loyalty Oaths or Perks

If a CL is not a member of United for Change or any of it's member caucuses that CL still gets to spend the weekend in the Rye Town Hilton (It's been shut down for a year so wherever it is in the future) or gets to go to the AFT thingy, or is treated with the same respect that we would want.

8. No More Creamed Fish at Executive Board Meetings

It's gross. It makes Hank from The Crack Team puke. Please. This must end. 

9. The New UFT President Must Visit the Boroughs

How freaking difficult is it for Mulgrew to spend a week each month visiting the borough offices and having town hall meeting. There are five days in a work week and five boroughs. It works. And please, no per-ordained questions. 

10. Never, Ever Say "Doing God's Work"

This is a pet peeve of The Crack Team. We're not doing God's work. God (if there is one or one that cares about the DOE) can do God's work. In the opinion of The Crack Team ,this remark is patronizing, condescending, and reeks of desperation as well as empty nothingness. 

And last, but not least...

11. ALWAYS BE THERE FOR THE MEMBERS

It goes without saying. Don't really need to elaborate. 


I am sure in the coming weeks and months myself and The Crack Team will come up with more ideas. Right now we are awaiting seeing the Bronx inundated with yard signs on all off ramps.

The Possible Upcoming UFT Election Surprise

 I think there is going to be a big surprise just before the UFT elections. Call me jaded, call me a cynic, but the UFT never does anything without a reason. 

Think about this. We lost our spring vacation almost two years ago. April 2020. Twenty months ago. At the October 2020 town hall Mulgrew said...

When arbitration is back up, we will move forward on Spring Break. Medical accommodations are based on a medical condition. We would have to do another one in Jan. Same documentation and everything.

The September 2020 town hall Mulgrew sayeth to the masses...

Dealing with the craziness that included Spring break which still needs to be dealt with.

I asked this almost a year ago on December 27, 2020...

For the answer President Mulgrew gave at the town hall of October 15, again, it seems that arbitration is now back up. Where in the pipeline is our monies? How long does the process take?  

We were told not too long ago that the final arbitration on our spring break pay will come this month, December 2021. 

But a question remains. If the arbitration is a victory, when will we get the money? 

The Crack Team has been trying to crack this mystery. There were many a late night session in which there was bickering and disagreement. Many a late night were had. Finally, a member of The Crack Team decided to go the computer. The algorithm was fed and the results were spat out.

Some might say The Crack Team's computer and/or the algorithm is skewed. Or, the information fed to the computer was jaded and cynical.

We will get the monies owed in our direct deposits week or two before the UFT election. And of course who gets to call the date for the election? Of course. UFT/Unity.

The computer must be right. Think about it. Why wouldn't it be?

Thousands of teachers get thousands of dollars they are owed for almost two years. Guess who will puff out his chest and say, "See what I did? I fought for you! I made you whole again!" 

And UFT/Unity will be like Justin Trudeau and call for early elections in just a few weeks. Or, and this is even more cynical, the election date will be already called and the checks will be mailed out just before the election starts. But either way, teachers will vote while having several thousand dollars more in their accounts and the great many of unwashed will thank UFT/Unity. And then vote Unity.  

But when these teachers vote for those that blessed them with money, what will they say when they want to see Dr Vinnie Boombotz for a prostate issue and find out he doesn't accept any Medicare (Dis)Advantage  patients?

I hope the computer is wrong. We shouldn't need to feel jaded and cynical when it comes to our union. We should feel we are partners with our union. We shouldn't have waited almost two years for A HEARING for our monies. 

But watch. The spring break money and the election will be intertwined.

The Crack Team Has A Mole Within UNITY

I have been thinking on how to handle all these accusations that have befallen me the last week and how to fix the hazarai that I unintentionally created. What can I do? 

I thought about it long and hard driving up to Ithaca yesterday. Suddenly, a light bulb popped over my
head when I stopped in Hancock NY. I promptly contacted The Crack Team and instructed that at least 10 members (We need at least 10 to have a minyan) meet me in Binghamton. Hancock being about 45 minutes from Binghamton forced The Crack Team to charter a jet and meet me at the Spieidie and Rib Pit on Front Street just off of I-81 in Binghamtom. The Crack Team had shared with me that they had planned for such an occasion and on this blog post for the first time ever,  some of the evil planning will be revealed

The Crack Team has not only a mole within in the UFT and Unity but has surreptitiously bugged the Unity Election War Room. All what you are about to read took place on Monday, November 1, 2020 the day after a certain blog post that had been posted but since deleted. 

Names have been changed to protect the evil.

Larry the Lobster: Did you read Zucker's blog last nigh?

Squidward: Yeah, we are fucked. XXXX is going to be part of this so called coalition.

Pearl: We are. What are we going to do?

Mr Crabs: We have to call out the big guns. I have placed a call to Plankton and Man Ray. We will have them do our dirty work while it will keep our hands clean and we will have plausible deniability.

A few minutes later Plankton and Man Ray enter. All Unity members greet them with raised fists and chant, "All bow to the evilness of Plankton and Man Ray."

Mr Crabs: Welcome Plankton and Man Ray, what evil plans do you have for our enemies?

Plankton: We have already begun our evil plan against the others. On November 7, 2021 I will leave a paper bag of doody on the leader of XXXX's doorstep, light the bag on fire, ring the bell and run away. The leader will be forced to stomp out the fire and only then will realize he had fecal matter all over his feet. 

Mr Crabs: Excellent and diabolical! That plan will surely make the leader of XXXX  run away and hide. Man Ray, what is your plan? 

Man Ray: My plan is pure evil. I will make several phone calls on November 8 to (inaudible) and ask him, "We are calling from the electric company and doing a survey. Is your refrigerator running?" When he answers "Yes!" I will tell him that he "needs to go and get it! (An evil laugh is heard on the audio). 

The next day I will call (Again, inaudible), and ask "Do you have King Arthur in a can?" These two phone calls are what we in the evil business call "psych ops." (Inaudible) will be left to a shriveling shaking mass, left to sucking his thumb in the corner and rocking back and forth.

Plankton: Who gives a shit about (inaudible)? (Inaudible) is just a bit player, no one really takes (Inaudible) seriously!

Man Ray: No, you dick! (Inaudible) is the glue that holds them together. 

Plankton: Fuck off Man Ray! 

At this point Plankton and Man Ray start to brawl. Plankton's Karen comes in and starts to mock Plankton for getting his ass kicked by shouting, "You are not a real man!" Mr Crabs just sits back with an evil laugh and knows that all is going according to plan. The gloves have come off of Unity. It is now a fight of Good vs. Evil.
