The NYCDOE Has Stolen Retro Monies From Me and Other Teachers

I've Been laying low. Having to deal with Dr Evil and Mini-Me.

So, what's new? Tell you what's new from me. The DOE stole money from me, and it seems others as well. Not once but twice.

My son had saved up money to buy a car over the last six months. I promised him that I would kick in some cash towards the purchase but it would have to wait until the retro came in. When it came in, it was a real kick to the groin...





RESTR SETTL PR is probably "restructured settlement". But what is the PR?

Yeah, I am out $727.33. Why? A bit of a backstory first. I was under suspension when my the retro was dispersed. Last year when I got my first retro almost everyone else was getting there second retro check. As I was told, the checks are divided by 1/8, 1/7, and so on, or something like that. Anyway, the amount I received last year was equivalent to if it had been my second (Like everyone else) retro check. The amount I was blessed with this year is equivalent to what I would receive (which should have been my first) in 2015, which would have been less than last year's check. Therefore, last year I received more than I should have. So due to some bookkeeping method I am out over seven hundred dollars.

But if I received in the proper ordinal order...1st, 2nd, and so on, I never should have been out these monies. But looking at it with my non-mathematician mind, shouldn't the checks have the same total amount in whatever order they were dispersed? This seems like it is straight out of Abbott and Costello.

And guess what? I am not the only one this has happened to! I have heard from many teachers that feel that they have been robbed and want their money back. Like now!

My question is how do I, or those in the same predicament as I know that the numbers, or rather, the math is correct with what we are owed? Or for that matter what anyone is owed? Why has there not been something on the payroll portal a clear and concise accounting for each teacher, how much total money they are owed and the amount of each year's payout? This would solve so many problems and help teachers to plan accordingly.

Though the UFT has been quite helpful to me and has been on top of it, I've been cautioned that though I might get the seven hundred dollars back there is a chance that I might have it again deducted down the road.

That is why I filed a payroll grievance and hopefully I will not only get my money back but if and when it goes to arbitration it can be ruled that there will be no further deductions. Not to mention the hope, there will be accountability on the decision and the logic behind why I lost this money but a full accounting on how my retro is decided.

Fortunately, my son has a car. But not to soon after we had purchased the car, we learned that he needs a passenger side axle along with an inner tied rod.

The parts won't cost me much. I delivered auto parts during my suspension and can by the parts at the same price the garages pay (The mark up is obscene!). As for the labor, I know some good street mechanics in the Bronx and have a garage in White Plains that'll do the job for $200 (Gustavo's on Ferris Ave in White Plains---Shameless plug!).

"Not to worry," I told my son, "this can be fixed for on November 1 I shall be receiving yet another blessing from the DOE, my retro per session check."

"Oh blessed be Mayor de Blasio and Mike Mulgrew," my son said whilst smiling.

November 1 came. So did November 2. November 3. November 4. Nothing, nothing, and more nothing.

For some reason my per session retro is "not showing in the system." Why did this happen? No one knows. However, there is good news. I have been added to the list "of people who need to be paid." Let's see here. The definition of people is...
plural : human beings making up a group or assembly or linked by a common interest
The main takeaway from this definition is that people is plural. So ipso facto many a person (meaning many people) has yet to receive their retro per session.

I even called per session pay roll on Thursday. Iouldn't get an answer. What a surprise.

This is really from the files of "You Can't Make This Shit Up!" I'm out over $800. I am sure there are those that are worse off. But there is no transparency. No communication. No nothing.  

But UFT members have been in the dark since 2014 when this contract was ratified and we were told it will take until 2020 (And myself and others in 2021) to be made financially whole again. I want my money.  Maybe I will have it in time for Hanukkah. In 2020.

BREAKING!! The ATRs and the New Contract!!!

Today was exciting. There is a new contract agreed upon between the UFT and the
NYCDOE. Yippee! We all got the emails today from Uncle Mike Mulgrew which was more or less highlights which barely touched on details.

But right now I just want to touch on the part of the contract that will pertain to ATRs.

First, I want to dispel the rumor that I have read first hand that ATRs will be disbanded, not by layoffs, but rather than placing ATRs in schools. Like forced placements. That is not happening.

As James Eterno and Arthur Goldstein mentioned, the date that ATRs are placed in openings in the license area has been moved from October 15 to day one of the school year. This makes sense. Does no one any good to start in October.

But there is more.

The Crack Team has learned through sources within the UFT that schools won't be penalized financially anymore for hiring an ATR with a high salary. For instance: Say a school has all first year teachers and 22 year ATR is hired. Ordinarily that ATRs salary would raise the average of the school's teachers salaries. Now, that ATR, that expensive ATR's salary will be seen as on par (Haven't a clue how this is being worked out) with the 1st year teachers salaries. That teacher making $119k won't skew the schools budget. Again, the devil is in the details.

Something else that is new is a new program that will hire ATRs into a program called 4x4. ATRs will be hired into schools (This will start of as a pilot program) in which ATRs will work with small groups of students in group literacy intervention. You won't need a reading license to do this. The curriculum will be scripted out and the cost borne by the DOE. In my opinion this is a long time coming. I have always wondered why ATRs are forced to do menial sub work when they could be better used to target in need students either individually or in small groups. But as usual, the devil is in the details.

But we don't have the details and neither will the DA tomorrow night until after a vote. Why the UFT couldn't wait until Monday to have the DA ratify the contract boggles the mind. Shabbas candles are lit tomorrow at 6:02 PM. It would be safe to assume that some CL's and delegates are Observant Jews.

MORE Misses Yet Another Easy Target

You know what is easy? Standing on a pitchers mound and having just get the ball to home plate 60 feet, 6 inches away. I'm 54 and a lefty. Dang I can do it! Heck, my son was able to do it at the age of 8!

MORE is turning into the Ba Ba Booey (Gary Dell'abate) of UFT caucuses by completely fucking something that easy up.

Instead of fighting for ATRs, work rules, working conditions, getting rid of the lawyers that permeate the DOE, fair student funding, teacher safety, teacher happiness, or any other of the myriad of other wants and needs we have going forward as we approach a new contract next year. MORE has decided to do the opposite. Or as one member has said...
"Dwindling health care benefits in exchange for a raise that will not help us meet the rate of inflation in NYC is a major problem for us."
This is the priority.


Yes, there are things I do not like. I do not like paying $50 to go to an urgent care center when the alternative is to see my GP when I have a cold or need to get in last minute. That is unless I go to Advantage Care Physicians which there is a $0 copay. The only issue I have is that there are 0 ACP offices in Westchester County. It does me no good.


I don't care for the $150 copay for the ER. Yes, I know it is waived if admitted, but not all ER visits necessitate being admitted.

I am not happy that first year teachers will have to spend their first year in HIP. But,most of these teachers will be young and healthy and do not need the care that the more mature teacher desires. Besides, I'm sure a goodly amount of the MORE people are young or living still on mommy and daddy's insurance 

I have no problem if my copays go up another $5. I really don't care. I have had a life without insurance. My right shoulder is a mess because I did not have insurance when I dislocated it. A dear friend of mine is dead because he did not have insurance.


What I do like is that I am paying $0 a month for GHI. That my wife has about $200k of hardware in her back, spent a week in Lenox Hill Hospital and two weeks in BurkeRehab Hospital and we only owe about $200.


I'm grateful for the hernia surgery I had last month was $0. I'm grateful that when my son broke his hand and needed surgery 5 years ago that the only cost was driving to NYU.

But again, another problem with MORE is they just can't or refuse to roll up the sleeves and see the world around them. In others words, REALITY. They think we have it bad.


Well The Crack Team did roll up it's sleeves and wishes to share a major dose of reality on the kiddies at MORE about health coverage across the country. These are true stories from real teachers.

I pay a little more than $450 a month for my daughter and me and ewe each have a $3000 deductible with a $5600 out of pocket maximum per year. We live in Idaho.

$1200/month for family coverage. $15 copay for doctor visits. In NJ, our healthcare contribution is based on our salaries so if you make more, you pay more for the same coverage. That jackass Christie came up with that. Prick. Can't live on my take home anymore.

For Chicago Public schools I pay about $18 a month for insurance, put in about $100 a month to an HSA w/ $600 contributed by CPS for the year, w/ a $2000 deductible. The insurance helps negotiate prices but basically doesn't pay anything until the deductible is met.

$350 a month premium, matched by the state (HI teacher), so $700 a month in premiums, $20 copay for everything, extra for lab work, TONS of other fees. They wanted $700 for an MRI that traumatized me to the core of my being and am refusing to pay.

I am paying $1400+ per month for coverage for a family of three. I would cheerfully choke someone out to pay $600 per month.

Albuquerque Public Schools, high option plan for family of 4 - approx $650/month, plus co-pays and percentage cost-sharing (which seem to get higher all the time!) $25-$40 co-pays for appts, $50 Urgent Care,  $150 ER, percentage of everything else.

I'm a public school teacher in the state of Rhode Island and I pay almost $400 a month for a single healthcare plan. I have different deductibles to meet for different things but just for regular doctors I have to meet $250 and then my co-pays Kickin, to go to a walk-in clinic it's now $100 and to see your primary care it's $25. I am ashamed that our state does this. Good for you and your school district not charging the teachers are ridiculous amount for health care. Best of luck on the rest of your school year.

In Michigan (law change in 2012) we now are required to pay 20% of the cost of premium.  A high deductible ($2700) with HSA account costs $270 a month for full family.  Same policy with coinsurance (%20 after deductible) costs $140 month for full family.  We formed a county consortium to pool policy members and help reduce the costs.  Before the consortium, we were paying $320 a month for the full family high deductible policy; which was our only option.

We do not use our district insurance because the premium is $1265 per month for our family of 4. Yes you read that right. Nevada has the worst insurance coverage in the nation for teachers.

$104 a month for the least expensive choice through my district, which includes my husband and two kids, dental and vision.  $7000 deductible, $10 doctor, $25 specialist, $52 urgent care, $75 ER
(unless admitted, then there is no co-pay). 


It's time for MORE to stop sniffing its own farts and get a reality check not only concerning the rank and file but life as well.

The Crack Team Announces It's Contract Demands

With DC 37 caving into the City and setting a pattern with a 7.42% raise over 44 months that's what it looks like UFT members will get once we get a new contract.

The Crack Team has gotten together and is willing to endorse such a pay raise but the support is conditional. Conditional upon what The Crack Team wants in return. This shall be known as The Crack Team's contract demands.

All ATRs must be placed. Not force placed, but rather intelligently placed. Each to the best of their abilities and each to a school in which the ATR can thrive and work in an environment that is conducive to the growth of said ATR and the school's students.

End Fair Student Funding. Mulgrew has said that the UFT cannot bargain budgetary demands. The Crack Team calls bullocks! When there is a will there is a way.

Bye-Bye Monday PD. A complete waste of time. There is no real professional development occurring.  I'd much rather watch hours upon hours of Kathy Griffin.

ATRs must be observed and rated as per diem substitutes are. In lieu of all ATRs being placed, ATRs must be treated as the DOE sees us. As nothing more than substitutes. Treat us the same way.

End Field Supervisors. If the above is impractical than do away with the field supervisors. Create with the UFT a truly transparent and fair method of observing and rating the ATRs. However the guiding philosophy must still be Teaching for the 21st Century.

Two observations per year for tenured teachers. I'm getting tired of meeting teachers from all over New York State and looking at their faces as I share with them we have 4 observations.

Bye-Bye Danielson. 'Nough said.

Discipline must be scaffolded. The contract states a "Counseling Memo." How often is a counseling memo used? All discipline at the school level should and must begin with a counseling memo. Too much mundane bullshit is settled with a letter to the file.

Clearly define what one needs to attain tenure. Too often now newb teachers are left in the lurch with subjective decisions on whether or not they will receive tenure.

All letters to file can be grieved. This was an injustice was this ended. Not being able to grieve all letters to the file just gave principals the ability to pile on the mundane crud.

Ability to face your accuser. Principals testifying by telephone? So much is missed when one can't see body language.

Principals held accountable. It is time that these principals are treated and subjected to the same methods as teachers are. Principals who are sued should stop being indemnified.

Bye Bye lawyers. Better uses for these lowest of pond scum can be put to better use by keeping the Trumps out of prison.

Bye bye 75% of the dead weight at Tweed and 65 Court St. McDonald's has been using computers to place orders. Stop and Shop has more self check out registers than manned ones. It's all the same.

Supply all ATRs with M&M's. Once a month all ATRs receive a bowl of M&M's, but there is a caveat. No bowl shall contain blue M&M's (Thanks to Van Halen for that idea).

If these demands are enacted (And any others I have missed) The Crack Team can live with the shitty raise.

Pay Dues. Don't Freeload.

The Westchester Journal News has reported that New York State has stopped collecting
agency fees from 31,000 state workers. As far as I am concerned that is 31k freeloaders and rats.

I am getting tired of this whining from UFT "members" who are threatening to withhold dues in light of Janus. Yes, as I ahve said in the past, I empathize with them. But a dysfunctional union is better than no union or not being in a union.

I have been reading a lot of the comments on James Eterno's blog. Yes, the grievances and feelings are real. But the one question I brought up and could not be answered to the complainers is, "What have you ever done for 'the cause'"? The question has been met with silence. Instead of cursing the darkness light a god damn candle.

I ask those that are thinking of freeloading that are reading this, what have you done? Where have you been? And please, anonymous comments on blogs don't count.

Even under the best of circumstances if the UFT was strong and proactive there would be people complaining and kvetching. Nothing is perfect. Too many are looking for a perfect fit on an off the rack world.

Yeah, our working conditions and the way we have been treated pretty much sucks. But we make more than most teachers in the country, let alone New York State. We have solid pensions awaiting us. We have rights that are bargained for. And, we have great health benefits.

Yeah, Mulgrew got stupid again about saying health benefits can be bargained. Would you rather have no health benefits? Crappier health benefits? A friend of mine that teaches in Armonk NY told me that he has a family deductible of about $6k on his health plan and pays into it 10% (or a little less) or so of his pay. If you have GHI you pay $0 and with the out of network rider (which I have) $16 a month.

I have been without insurance and on insurance. Guess which I prefer? Thirty years ago I dislocated my right shoulder (I am a lefty). It was popped back in never saw a doctor because I had no way to pay for it. I have developed horrible arthritis, I have bone grinding against bone, I'm in pain, can't golf, and I will need a shoulder replacement eventually.

In January my wife had almost her entire back fused. We saw the hospital bill. It cames to about $550k, with about $200k for the hardware in her back. Maybe another $95k for the bed. We owe $200.

This is what you can give up if you fail to join the union and other things as well. Under law freeloaders are covered by the CBA. Well, what happens if the next CBA there are provisions for freeloaders to be own their own? Too bad.

Remember, how the UFT got the family leave (Yes, it's not parental, stop bitching.). And something that was just shared with me. Family leave was negotiated outside of the contract so we would not have to do a quid pro quo. Yeah, sometimes the UFT gets it right.

But the worst thing, aside from being a freeloader, for not paying dues is that you will hurt each and every member staying in the union (I've been to a union meeting already. The anger at the freeloaders is just beginning), in negotiations, in solidarity, in advancing our needs, and more importantly, the needs and wants of the communities we teach in.

Being angry and frustrated is fine. Acting out on being angry and frustrated impulsively and for spite will hurt others and worse, yourself.

Mulgrew and UFT Came Through on Parental Leave

I am or was agnostic about parental leave. Kind of the way how I feel about inter league play in MLB. If the Yankees never played the Reds (except in the World Series) again I couldn't care less. I mean heck, my wife is 55. Her child bearing days are over. But we have it and I am happy for those who plan to take advantage of it. I would have much rather have had family leave, but let's take it step by step.

My biggest concern about parental leave was how much it would cost me and others in my past their child bearing years cohort. Having the contract extended another 73 days plus full salary for six weeks is not bad. Look at what DC 37 gave up for family leave. Yes, DC 37 will get up to 10 weeks, but only up to 55% of their salary. Plus, they will have .13% deducted from each pay check.

Having said that, we got the better deal and it could have been worse if it were not for Mulgrew.

A very very good source has shared with The Crack Team here at SBSB that the city was originally demanding a deduction from our check of .5%. After confirming with my 17 year old son, .5% is more than .13%. Mulgrew held his ground that there would be no deduction.

Plus, the timing of the announcement last week was no coincidence. Mayor De Blasio was about to fly down to Texas to show solidarity with the parents and children being separated but he was about to be shamed by the UFT for showing more concern for the children down in Texas than the unborn children of NYC teachers.

I'll give credit where credit is due. Let's hope this holding firm is a pattern in the upcoming contract negotiations.

Tyranny Running Amok at the MORE Caucus


MORE is slipping further and further into one person rule, with extra-judicial policies and
penalties, and rule by the few and not the many.

As many might know by now to prominent teachers and activists were retroactively punished and humiliated for going against the norms whims of a few. This led to ICE at first putting out a resolution to suspend support for MORE and then ultimately, after being democratically voted upon, to follow through.

The following landed in my email yesterday. This is what has sadly become of MORE. No dissent. No contradictions. No nothing except conformity. My thoughts will appear in red.

Dear Fellow MOREistas,

As some of you may know, many of the Independent Community of Educators (ICE) were integral members at the formation of MORE along with others. Over the last few years, while everyone has worked hard to organize around issues that have plagued our working conditions, internal tensions have also deepened. There have been some fundamental differences that have taken us back to debating some of our stated values over and over again. Differences in opinion and disagreements are absolutely normal and part of healthy democratic spaces. However, some disagreements have crossed the line to personal attacks and questioning of intentions. It has made it quite difficult to focus on what brought us all together in the first place.


No, there has been ZERO discussion about working conditions. No nothing by MORE. Nada. Bupkus.This argument made here is specious and disingenuous. However, MORE has spent an inordinate amount of time furthering left wing propaganda, anti-Israel and anti-Zionist screeds, and trying to churn up race wars within the UFT. 

Again, how does this benefit the rank and file?

To be fair, we have not had a clear process for when conflicts have become personal between individuals, though efforts have been made. In the last few months, things have come to a head, and ICE issued their decision to withdraw their support of MORE as a group. Some of us, listed below, have come together to respond. This response is an attempt to acknowledge their decision and agree to work amicably together as separate organizations into the future. We want to be clear that the folks here came together organically without any intentions of leaving specific individuals out. (Most of us were at the last few general meetings or worked on a committee. Others expressed their concerns at previous meetings.) 


No. ICE voted to SUSPEND support for MORE, not withdraw. Big difference. 

This statement is intended to propose a solution for us to be able to move forward, during a time when we need each other the most. This has been a learning opportunity about the need to develop a healthy organizational culture and something that we must do together as members of MORE. 


Response to ICE suspension of support for MORE


ICE (Independent Community of Educators) has voted to suspend their support for MORE (Movement of Rank and File Educators). We respect their decision to do so and we believe that both MORE and ICE will be able to achieve more in coalition than we can in the current situation.


We look forward to continuing to working together with ICE and its members on joint projects where our interests coincide - including in the CASCADE coalition, on the Chapter Leader Meetup listserve, and the UFT Executive Board.

Why should the grown ups on the Exec Board cooperate with MORE? After reading Arthur's blog yesterday, I was appalled that those few in control at MORE were upset that Arthur dared to bring up a class size resolution.


However, ICE members have coalesced around specific disagreements with the majority of the active MORE members. The current situation, with constant infighting and a toxic and mistrustful environment, is destructive for both MORE and ICE members. 

The majority of MORE members or the majority of those that were at the last MORE general meeting? Big difference. If this statement were to be true, a vote should go to the entirety of MORE, not just a few select followers. 

Better yet, after the coup d'etat on steering by the ex post facto rules and shaming of Barry and Tony, that (for lack of a better word) faction of MORE's steering lost it's majority and only the the insentient and one special little boy that is easily suggestible, followed orders. From the looks of thing these attacks on both Barry and Tony were pre-planned and possibly conspiratorial so the very faction they represent (teacher's rights, bread and butter issues, reality) would be effectively silenced and better, publicly flogged. Which in turn will be a warning to others who dare run afoul of individual thought


1. ICE has publicly rejected the decision by MORE steering, which was supported by MORE members at the General meeting on April 28, to enforce norms of behavior for MORE members.

Incorrect. It was not about enforcing the norms! It was about the whims! Read here. We asked that the suspensions be rescinded. We respected the vote. We, ICE, did nothing to do an end run around the vote. More bothersome is those that signed onto this letter to ICE and those that voted on the extra-judicious penalties many are chapter leaders in their schools. How would they react to a principal or administrator acting in such a way that they continue to condone? I voted my conscious on Steering and in the general meeting. Is that against MORE by-laws?

2. Some ICE members have publicly attacked MORE’s democratically-decided positions and organizing campaigns -- such as our "No Givebacks" position on Family Leave (a position which is consistent with MORE's Mission Statement) and our recent criticisms of the Unity leadership of the UFT for saying the Black Lives Matter Edu Week of Action was "divisive." Some ICE members have also posted internal MORE documents and discussions on their blogs and social media, despite being specifically asked not to, thus undermining our ability to decide together how to present our campaigns and positions. 

Publicly attack? Prove it. What does MORE consider "attacking?" To publicly question MORE and it's defacto leaders? To think as an individual and not as a drone collective? And yes, I did proudly publish it. When did MORE become an opaque organization?

3. ICE members who were present at MORE's April 28th General meeting rejected the "Contract Strategy" proposal that was voted on to be the central organizing focus of the caucus moving forward. 

Yeah, we did. I voted my conscious. I can't speak for others who voted no. But remember, there were also abstentions. Are these people to be vilified and punished as well? 

While ICE and MORE may be able to work together in the future, these differences indicate that ICE and MORE are different organizations with differing political visions for building a democratic, member driven UFT points of view. 

DEMOCRATIC? How has MORE acted democratically of late? If one wants to cite the United States Constitution as something to look to as an example of being democratic as a brought up at the general meeting attempting to rescind the suspensions of Barry and Tony, " that Article 1, Section 10, Clause 1 of the United States Constitution that no law shall be made ex post facto." But alas, someone blabbered that it only pertains to the government. No duh! But is MORE above the government? Is MORE above what makes us Americans? Sadly, I am learning the answer.

Besides, the "contract document" is so unrealsitc and bereft of anything for the thousands of teachers and UFT members. All this document does is solidify for a select few the bonafides and aspirations for a select few in a minuscule amount of outside agitating organizations. 

As of now, we ask that all members of ICE active in MORE choose between the two organizations.  We believe that a better working relationship will be possible once this separation of our organizations is settled.

So one can't do both? In fact why is it not the opposite? Why can't the below 17 members who put their names to this "invitation to leave" just leave? If it's your ball, take it and leave. Start your own little club or whatever it is you wish to call it?

But here is the problem. Should this not be put before steering and then to the ENTIRE membership? Again, this is MORE making up its rules as it goes along. 

We are willing to meet upon request with ICE or with individuals affiliated with ICE to discuss the reasons for these decisions and the terms of our working relationships moving forward.

This comes of so condescending and patronizing.

New Action Caucus Contract Proposal

On Sunday the readers of this blog were blessed to read MORE's contract demands. This was done as a public service for all NYC DOE teachers. We here at SBSB decided that there would be no commentary nor editorializing concerning the demands of MORE. This decision was made with the reader in mind. That we here knew that the NYCDOE teacher will be able to make up their own discerning mind and be able to comment or study the demands on their own time.

Thanks to the hard work of The Crack Team we are presenting the New Action Caucus contract proposal.

New Action has seats on the UFT's High School Executive board along with such stalwart's Arthur Goldstein and Mike Schirtzer. New Action is primarily made up of grown ups, veteran teachers, who know what the priorities of a caucus are and serve the rank and file, and not the collective, in the best way they can.

MORE Presents It's Contract Demands of the UFT (Seriously)

The Crack Team has studied the MORE contract demands that will be presented to the UFT in the coming months (At press time we are awaiting word whether or the presentation will be private or a public one with marching bands, parades, releasing of the doves and an other ritualistic overtones).

This is what MORE wants the rank and file to get behind eventually, akin to God handing down 15 10 Commandments to Moses at Mt Sinai.

Fight For UFT Contract This Saturday!!

Thinking of Not Paying UFT Dues After Janus?

Janus is looming over our heads. How will the Supreme Court rule? If it rules against the unions, how narrow or broad will the decision be?

As many know, Governor Cuomo signed into law that effectively will take away free union lawyers to any member that does not join a public service union, in our case, the UFT...

The unions, for instance, will not have to provide free legal representation to these non-members in statutory or administrative proceedings.
The way I have have read this and from conversations is that if one decides not to pay their dues you will not have free representation for arbitration hearings or 3020-a hearings. Fine by me.

However, those that decide to go this route will still be entitled to all rights and protections in the current collective bargaining agreement. But from what I have heard, and my source is very good, that those rights and protections can only be taken away through collective bargaining.

I am still awaiting confirmation from others concerning losing rights, but I have no problem with it.

I know, the UFT has been unresponsive and is reactive, not proactive, to the needs and wants of the rank and file. But the only way to affect change, the only way to solve the problem is from within, not from without. I would rather have a dysfunctional union than no union at all.

Why should any dues paying member have to carry a non-dues paying teacher? I am not taking anyone's rights away from not paying dues. That is someone's right. It is also someone's right to suffer the consequences of their decision.

I will have no problem if the UFT in it's upcoming contract negotiations agrees to two sets of contracts. One, for the members paying dues, and another, for those that refuse to pay dues. Basically, one will get nothing and like it.

Salary schedule? Out the window. Negotiate your own salary. Health and pension benefits? Bupkus. Negotiate on your own. Lunch, preps, hours, you are on your own. Working conditions? Tough toenails.

If I am a member of a country club, I get full access to the golf course, pool, and dining. Why should I be playing my 18 holes and share the course with someone who is not a member of the club?

I have box seats at the Yankees, why should someone with bleacher tickets sit in my $350 seats?

I empathize and understand the anger at the UFT. But if there is nothing, it will be much worse. If you decided to go on your own, you will be much worse.

Don't cut off your nose to spite your face.

MORE Demands of UFT President Mike Mulgrew

I'm not at liberty to say who wrote this. This person is an indispensable member of MORE.

MORE plans on bring front and center in the demands of the rank and file during negotiations for our new contract. The rank and file and MORE will be heard!  Loudly, clearly, and succinctly.


Dear Brother Mulgrew,

Thanks to you and the Division VP’s for eliciting member views through the contract surveys.   I hope this is just the beginning of a local-wide conversation as we make the necessary preparations to defend our living and working conditions, and public education itself, in very challenging circumstances.

Here’s my gist on our upcoming contract negotiations:   

No Givebacks - No Zeros - No New Contract – No Work

Janus or No Janus we have a Democrat Mayor and Democrat Governor who are trimming their budgets to pass along the Federal budget cuts to the public-sector workers of New York.  No doubt de Blasio and Cuomo will point fingers at one another and the Federal government but where does that leave the UFT contract come November?  

If the Supreme Court rules as expected, the UFT will be preoccupied in the coming months to maintain its membership and financial solvency.  How does the SCOTUS ruling combined with trickle down budget cuts affect the bargaining position of the UFT?  

The best response to Janus and Trump et al is an informed and organized rank and file, in close alliance with other workers and our school communities.  The time to organize is now.

We must hold our local and state politicians accountable and demand a decent contract by November 2018.

SBSB EXCLUSIVE!!!!! MORE Caucus Presents 2018 Contract Demands

With it being 2018, the contract is up this coming November. The MORE Caucus being in control of the Unity/UFT's executive board has not only a front row seat to the upcoming negotiations, but is not on the outside looking in and has established contacts within the UFT to be heard. Yes, it is nice to show how technological adept one thinks they are in posting nice little online polls on Facebook with "cool" graphics. But that gets one nowhere.

MORE is fighting an uphill battle every day. Unity/UFT continues to try to swat away MORE but MORE is here to stay.

With that being said, The Crack Team reached obtained the contract demands MORE is presenting to Unity/UFT tomorrow night at the exec board meeting. Today, right now, will be the first public airing of the demands and it should put Unity/UFT on notice.

Notice: Some names have been redacted.

1. Real raises: Set a pattern or follow a city pattern with raises that are equal - to uniformed/sanitation workers-
We expressed that HS members were especially upset during the last contract with delayed retro and raises that did not follow the pattern of other union workers in. UFT acknowledged this and said the first thing the city negotiators will argue for is "increased productivity"

2. Do away with C-6/professional assignments so HS teachers can have two full preps to prepare, especially those that are in ICT/ESL co-teaching situations
IF C-6 cant be totally done away with then pedagogical related assignments only (no lunchroom duty)-  (this  also addresses the proliferation of teacher teams)
UFT claims reps go to high schools through-out the cities the prevalent complaint from faculty is the lack of time teachers in co-teaching situations (Sped/esl) have to work with each other, if c-6 cant be done away with they would like to see something to address this using c-6 and PD time

3.Class size violations - with the proliferation of oversized classes we need some type of accountability for DOE/principals every day that a class is oversized the contract.
UFT will meet with xxxx to come up with a joint reso and action on this. XXXX has worked closely with class-size matters on this and has argued several grievances on class-size violations in his school. UFT agreed that class-size is a priority.

4. Unit pricing (stop the so called fair student funding formula-which "charges principals more for veteran teachers)- XXXX says they were at least able to get this to the negotiating table last time
This would solve many problems from class-size, ATRs, to inequities in schools 
UFT said we did bring this up in the last round and the city answered it is not an item that can be bargained, but its worth bringing up again

5. Regents grading in schools- same as unit pricing, UFT can bring up, but not something we will necessarily bargain

6. Transfer system -seniority/sbo- at least a partial return to seniority transfers"
seems highly unlikely this will happen

7. 2 observations for tenured teacher- this is the state minimum
 We brought it up, UFT hears us, but they (uft unity( have a different take which they expressed at ex bd and DAs (the current system protects teachers)

8. teacher diversity and school integration - can we collectively bargain actions to address this?
UFT said it takes two willing partners, UFT has been aggressive on both fronts but hasn't found the same commitment from DOE. They would like to expand the para-professional to teacher program, they can bring it up in negotiations and do something like they did in the last round. paras have a higher percentage of people of color than teachers. 

9. DOE PD'S that occur in schools will be accredited towards CTLE hours
UFT spoke about how long it has taken DOE to receive proper certification to even be a provider, we pressed that UFT members with families, childcare, elder care, grad school can not be expected to fulfill these requirements-the PD time in school ought to count for CTLE

10. Due Process for UFT members under investigation or Exonerated (UFT will look more into this- but this is what we offered:

A small adjustment for the type of outside complaints described would be for a parent to have to come up and sign a complaint in writing that was made by a student. Those things don't currently happen and would filter out a fair amount of capricious complaints. 

Another small adjustment would be to require the investigation process to consider the intent as part of its process. This would compel all parties to consider context of any action in their decision. Investigators' final report should have to state the apparent intent behind the act in writing in their final report.  This would absolutely lighten the burden for those who go through the process. It's a small shift but it has powerful consequences on all levels. The DOE is the only district in the state with a bureaucracy to support investigations like what we have. The local CBA (our contract) needs reflect that uniqueness with fairness protections (many of which that haven't yet been though of yet) That do absolutely account for that. 

A larger shift would be to advocate for a written schedule of fines or punishments for infractions reflective of progressive discipline and for that schedule of fines/punishments to be made public.

In general, significant efforts should be made to make the discipline process more fair and more predictable. This would take that process out of the hands of a vindictive administrator and protect teachers and students. 
11. immigrant liaison- UFT passed a reso on this- can we collectively bargain training for UFT members, add this to comp-time menu and c-6- UFT asked how do we envision this- we said offer training for members and like the respect for all and sustainability coordinator- have it be someone that is trained and listed throughout the building. Also possible offer it on the SBO comp-time position and/or C-6. UFT said they will follow-up

Mazel Tov UFT!!

A hearty handshake is extended from us here at SBSB to our leadership at the UFT for not only being at the forefront, but for having the foresight, to not only oppose Proposition 1 in this past Tuesday's statewide vote, but also in the defeat of the aforementioned proposition. Kudos!

Not only that, the UFT is publicly preening itself in self-adulation as a teenage boy who has lost his virginity in playing its part. Yes, the emails, the phone calls, the robo-calls, and even the text messages from real people got 82% of voters to say heck no to Prop 1.

Just how much is the UFT kvelling in it's unprecedented "win?" Let's just look at Facebook...

So here is what I, and I am sure many others want to know. Why can't the UFT put the same time and effort in for its members that it does for defeating a NYS Constitutional Convention?

Why can't the UFT put the time and effort into doing away with the fair student funding which is keeping many qualified teachers from permanent positions?

Why can't the UFT put the time and effort into fixing the ATR problem?

Why can't the UFT put the time and effort into exposing abusive principals?

Why can't the UFT put the time and effort into make our union a true democratic union in which different ideas are debated and respected?

Why can't the UFT put the time and effort into enforcing our collectively bargained contract?

Why can't the UFT put the time and effort into ensuring that every member, whether active or inactive gets every last cent due them of monies owed since 2009, regardless on how one left the DOE?

Why can't the UFT put the time and effort to have ensured that we all get our retro in one sum, in 2015, instead of waiting until 2020 or 2021, both over a decade from when we should have had a contract and a raise.

Why can't the UFT put the time and effort into just doing the right thing? Really? Is it that difficult?

My dad used to tell me you can do anything you want when you decide to put your mind to it. Maybe the UFT should listen to what my dad had to say.

Oh oh. As usual the devil is in the details and the devil ain't looking too good at first glance.

We all got the email from Mike Mulgrew espousing the latest ($5 bet we are going through this again in 2 years) evaluation system. As usual it seems that Mike pulled a George Steinbrenner. He was negotiating against himself.

The Crack Team and I went over Mulgrew's email with a fine tooth comb, but several things raised (and upon further reading I am sure more will) our eyebrows here at SBSB and our raised eyebrows raised our BS perception.

The new system, when fully implemented, will include more authentic student learning measures — from essays and projects to demonstrations of proficiency in physical education and the arts — that genuinely demonstrate what we do as teachers and what our students are learning.

When I was reading this email at lunch today I just happened to be sitting with the gym and music teachers at my school. Fate.

Anyway, proficiency is defined as;

So students must become experts in a sport or physical skill? How do we in the schools, many of whom are athletically spastic decide what is or isn't? How do we decide what is proficient when it comes to the arts? 

I can't sing a note. I can't play an instrument. There is no amount of instruction that will get me to be able to be proficient in either. Now, I do enjoy listening to music. For those that have read my blog you know how much of a Rush fan I am. But does that make me proficient in the arts? Will appreciating a painting make me proficient? 

Same with sports and I will use my son as an example. Since he has been 6 he has been in baseball training. He has been lucky enough to play travel and school baseball. He's a good catcher but he has some things to work on. He has a bit of a long swing that we've been trying to correct for years and he likes to pull the ball. With all the training he's been through, and could it be the instructors fault, should he not be able to overcome those hitches in his swing? Or does he have a mental thing going? Baseball is 90% mental, no? 

But again, to put the onus on the impossible is just wrong. Yes, anyone can throw a baseball or play the riff from "Smoke on the Water," (I can!) but not everyone can pitch like Koufax or sing like Freddie Mercury.

We went into those negotiations saying that any agreement must reduce the impact of standardized test scores

Reduce the impact? I'm so confused here so I checked out ICEUFT Blog for further clarification...
As for the rest of the agreement, it looks (like) test scores will count for half of teacher ratings instead of the current 40%.

I'd like to know more about what James meant, but here is the thing. Aren't we, and I mean we by teachers, parents, educators, grown-ups, etc... holding all the cards here? The opt-out movement is still gaining steam. The public sees through the charade now. Why are we folding when everyone at the table just has a pair and we have a flush?

Under the new system, there will still be four observation options, but we’ve expanded the choices for teachers rated Effective or Highly Effective in the prior year.  Starting in the 2017–18 school year, teachers rated Effective — in addition to those rated Highly Effective — may choose Observation Options 3, which includes a minimum of four informal, unannounced observations plus teachers agree to open their classrooms to colleagues for at least two non-evaluative classroom visits. Highly Effective teachers may also now choose Observation Option 4, which includes a minimum of three informal, unannounced observations plus three times when teachers open their classrooms for a visiting colleague to observe and learn from their teaching.

Isn't the deal of negotiating is to reduce onerous crap that the rank and file doesn't want not to increase it? Here is an example. I own a restaurant in the Bronx. The law requires one (or it can be two) health inspections a year. Now do I as a Bronx restaurant owner go to the city and ask for more inspections a year? NO! But in UFT world more 9pardon the pun) is good and less is very, very bad.

By the way, I am leading the charge to change the law regarding car inspections in New York State. I can't live with myself knowing that my car is inspected only once a year. I insist that my car is inspected bi-monthly.

Seriously, who thinks up this shit that more observations is a good thing and a win?

What is most disturbing is this. The timing of the announcement. Two days before Christmas break, two days right after an executive board meeting in which the high school seats are controlled by MORE. Something stinks and it ain't coming from New Jersey.

Right before vacation so there is no real time for teachers to get together in their schools to discuss what they really think about the new evaluation system and to learn more and to contact the UFT to share what they think. Remember, UFT offices are conveniently closed next week.

This news could have also been shared at exec board meeting this pat Monday but wasn't Heck, at the very least it could have been shared at the very least that an agreement was near and give all members parameters of the agreement. I guarantee you this...

If MORE was not in control of the high school seats this would news would have been out on Monday.

But now comes the hard part for the UFT. Let this process be open and fair! Let there be true debate and feedback in the chapters. Let the DA be a source for free and fair debate. Share all information with all members of each and every executive board. And one more thing.

After a sufficient amount of time (one month?) with the rank and file having access to all sides of the debate allow us, the teachers, the ones closest to the action to vote up or down on this evaluation system. We know what is best for us not 52 Broadway.

BREAKING!!! Possible New ATR Agreement and News You Should Know!

Let's get something out of the way. Your CAR is safe. The number of sick/personal days is safe. They are not being traded in for FLMA. There is no need to worry. 

Someone, David Irons, the author of the "Vote No on the UFT Contract" Facebook page  has started this rumor which Chaz was quickly able to disembowel.

Why would David start such a rumor? Perhaps someone within the DOE shared this with him? Maybe he was on the bowl in the UFT executive washroom and heard this? Who knows? What David fails to realize is it takes two to tango, and this could have  very well been an opening salvo from the DOE which the UFT promptly shut down. Yes, the UFT (if this offer was made) can be more transparent. This lack of transparency unfortunately allows the likes of David Irons to operate unfettered.

One must consider the source as well. David operates his Facebook page anonymously with zero accountability. We call on David to share post haste with all his readers who he is, what he stands for, and more importantly, who he stands with. 

What David doesn't share readily is that he suckles at the teat of the UFT Solidarity trough. Through UFT Solidarity David has learned the art fear and misrepresentation. David also has major issues (Seriously, MAJOR ISSUES!) with the UFT and needs to psychologically project (Oooh, who do we know that is that way??) with others.

But The Crack Team is surprised that David has only scrapped the very tip of what the UFT is currently negotiating currently. As we know the UFT is in negotiations with the NYCDOE concerning evaluations and ATR's. We here at SBSB wish to share with David Irons what The Crack Team has been able to learn from multiple sources as to the future of the ATR pool.

Starting in September 2017 each ATR...

Required to download an app onto their smart phone to be tracked.

Required to sign a agreement that they are worthless and weak.

Sign a waiver releasing the DOE from assigning bathroom keys. 

Must wear an obedience device like Captain Kirk (going shirtless is optional for male ATR's) did in "The Gamesters of Triskelion" .

Can not park their cars within one quarter mile of any NYCDOE school in which they're assigned.

Must eat lunch no later than 10:35 AM and must only eat food served in the cafeteria.

On days that school is not in session must show up and wait outside until given permission to leave.

Must leave home no later than 5 AM if the ATR takes public transportation.

Will not be required to sign in at the school safety desk. This will be replaced with a retina scan.

Must address all teachers with less than three years experience as either sir or ma'am.

When addressing all teachers with less than three years experience eye contact is forbidden. 

Must walk at least three paces behind any teacher with less than three years experience. 

Must give up their seat in any and all places where teachers congregate to teachers with less than three years experience. 

Must appear for mandatory interviews in which the ATR will be notified 15 minutes beforehand to attend.

And last but not least, must sign away their soul to the new NYCDOE ATR ombudsman which upon death will prevent the NYCDOE from a fulfilling afterlife but rather be rotated between Hell, Purgatory, and Heaven (There is one upside to this. Jews do not have concept of Hell or Purgatory so get ready for an influx of ATR's converting to Judaism).

Surprised David Irons has not found out about this possible ATR news. Surely, he would have reported this as he did his news about the CAR.
