MEMO FILED BY THE FIRST RESPONDENT

The Counsel for 1st Respondent herein humbly submits as follows:

1. It is prayed that the memo dated 23.01.2025 filed by the 1 st


Respondent may be read as part and parcel of this memo also. As per the
affidavit of undertaking dated 03.01.2025 filed by Mohmed Rafi in CRP No.
5314 of 2024 before the Hon’ble High Court, Madras, the second
Respondent herein vacated the premises on 18.01.2024 at around 4 p.m.
and handed over the key of the premises to the 1st Respondent.

2. However, a few articles belonging to 1 st Respondent which were inside


the premises (as per Exhibit P1 - Rental Agreement dated 24.07.2017)
were missing and the second Respondent did not give a proper answer
when questioned about the same.

3. Vide Order dated 03.01.2025, the Hon'ble High Court Madras was
pleased to pass the following order:
“9. It is left open to the parties to workout their rights
independently with respect to any claim that they have as
regards arrears in an independent proceedings.”

As such the 1st Respondent prays leave of this Hon’ble Court also, to the
1st Respondent to initiate appropriate action against the both Appellant
and the 2nd Respondents seeking the recovery of rental arrears, missing
articles or their equivalent value along with other legal remedies.

4. A copy of the order dated 03.01.2025 passed by the Hon’ble High


Court, Madras is submitted along with this memo for the ready reference
of this Hon’ble Court and the same may be recorded.

In the above circumstances, it is therefore prayed that this Hon'ble Court


may be pleased to record the above memo and pass suitable order as this
Hon'ble Court deems fit and proper and thus render justice.
