As a resident of Deltona, it is important that you become

aware of ordinances that are often associated with
property ownership. On behalf of the Mayor and the City

laws of the City. The purpose of this Golden Book is to
advise you of specific ordinances related to your
property, as well as information about City services that
will be beneficial to you.

In this booklet, you will find a small list of common

ordinances with which Deltona residents should make
sure they are in compliance. All City ordinances can be
viewed by visiting the City’s Code of ordinances website
at the following website address –
“https://library.municode.com/fl/deltona/codes/code_of_o

encouraged to visit this site to familiarize yourself with
these and other relevant ordinances.

Please review your property and how it looks compared

to the following ordinances, and make corrections as
needed. Please be a good neighbor, because together we
can make Deltona an even better place to live.

If you have any questions or

find your property out of

Deltona Code Compliance
Division at (386) 878-8700.

One of the primary missions of the Deltona Code

Compliance Department is to address concerns of blight
and quality of life within the community. Blight, such as
dangerous and unsafe buildings, abandoned/inoperable
vehicles, debris, and overgrown grass and weeds has a
harmful impact on a community. Blight lowers property
values, increases crime, hurts a City’s economy, and
damages residents’ quality of life and connection to their
community. Blight is defined as a condition that impairs,
destroys, or deteriorates a property because of its decay,
improper storage, or effect on property or quality of life.
Deltona Code Compliance seeks to work in cooperation
with the residents of Deltona to provide attractive
neighborhoods through practical code enforcement. If
you know of a code violation that is lessening the quality
of life for yourself or your neighbors (dangerous
buildings, inoperable vehicles, etc.) please alert the
Deltona Code Compliance Department at (386) 878-
8700.
Common Violations
Building/Housing code violations
Zoning violations
Abandoned/Inoperable Vehicles
Overgrown grass and weeds (above
12 inches)
Trash or Trash Cans at the curb
before/after permitted time
Scattered litter or open trash on the
property
Indoor furniture in outdoor area
Yard waste improperly left at the
curb for collection
Improper placement of signs
Unlicensed, barking, or at large
animals

P R O C E D U R E S & M E T H O D S

Procedures - Once a complaint is received alleging a

violation, a case is opened and assigned to a Code
Compliance Officer.

8
Chapter 162 of the Florida Statutes states that a Code
Compliance Officer must, through his or her own
personal investigation, verify that a violation exists at the
property.
If the officer is unable to verify a violation exists, the case is
closed as unfounded.
If a violation does exist, the officer must make the
determination as to how best to bring the property into
compliance.
It is the City's desire to obtain voluntary compliance via
education.
Each violation must be looked at on a case-by-case basis
to determine how best to gain voluntary compliance in the
least amount of time.
Since voluntary compliance is not always possible, each
case must be worked with the understanding that it may
end up in court before a County Judge or in front of the
City's Special Magistrate.
Methods - Once a violation
is verified, the person in
charge of the property is
notified and given
information on how to
correct the violation in a
reasonable amount of time.
If the property continues to
be in violation, the Code Compliance Officer has a
number of options to bring about compliance. These
actions include:
Parking-ticket
Citation (goes to County Court)
Officers are authorized to issue citations under Chapter
162, Florida Statutes.
A judge in a county civil court hears the facts and
determines under the law whether or not the alleged
violator committed the alleged violation.
A violation of a code of ordinance is a civil infraction with
a maximum civil penalty not to exceed $500.
Notice of Hearing (goes before the Special Magistrate)
Special Magistrate is a quasi-judicial body whose
creation is enabled by Chapter 162, Florida Statutes.
The Special Magistrate hears the facts and determines
whether or not the alleged violator committed the
alleged violation.
9
The City of Deltona Special Magistrate is an attorney
under contract with the City and is authorized to
impose administrative fines and other noncriminal
penalties to provide an equitable, expeditious, effective,
and inexpensive method of enforcing any codes and
ordinances in force within Deltona. The maximum fine
the Special Magistrate can apply is $250 per day, $500
per day for a repeat violation.
A repeat violation is the same violator with the same
violation. Not necessarily the same address.
Abatement (City hires a contractor to clean the property,
cut the grass or tow a vehicle)
Abatements are authorized under Chapter 38 of the City
Ordinances.
Normally used for vacant properties and undeveloped
lots with nuisance weeds, accumulation of waste, yard
trash, rubble, and debris.
Officer provides property owner notice and allows time
to clean the property. If the owner does not correct the
violation, the City will hire a contractor to abate/clean
the nuisance property.

Tax Information You Should Know

1. Information about past property tax or property
dimensions can be found online at
https://vcpa.vcgov.org/.
2. Florida property taxes are unique because:
a. Taxes are levied annually.
b. Taxes on each parcel of real property have to be paid in
full and at one time (except for the installment method
and homestead tax deferrals).
c. Discounts are extended for early payment.
3. Valorem taxes or real property taxes:
a. Are based on the value of such property and are paid at
the end of the tax year.
b. The tax year runs from January 1 - December 31.
c. The Office of the Property Appraiser establishes the
value of the property, and the Volusia County Council,
Volusia County School Board, Deltona City
Commissioners, and other levying bodies set their
millage rates.
d. One mill equals $1 per $1,000 of property value.
i. In cases where the property owner pays their real
estate taxes into an escrow account, their mortgage
company should request the tax bill. In such cases,
the property owner would then receive an
informational notice stating that the original copy of
their tax notice was sent to the trustee of their
escrow account.
4. Current year taxes become delinquent on April 1.
a. On April 1, all delinquent parcels are assessed a
minimum charge of 3% in accordance with Florida
Statute. Delinquent real estate parcels will incur
advertising and auction listing fees.
5. Notice to taxpayers entitled to homestead exemption.
a. If your income is low enough to meet certain conditions,
and the total mortgages and liens against
the parcel are low enough, you may
qualify for a deferred tax payment plan
on homestead property. Deferral of
taxes does not excuse the debt. The
deferred amount will accrue interest
and must be paid at a later date.
