as there is no -f option as in cp(1), the manpage should be explicit
about what happens in cases e.g. when the remote file is 444 mode,
etc.

or add a -f option.

if it indeed copies a 400 file onto a 400 file, then it breaks with
the cp tradition.  even with -p.  at least the man page should talk
about this.

if it refuses to overwrite it then it should return an error code,
etc.
