You're incorrectly thinking the EU cookie law applies to all cookies. It only applies to tracking data, including tracking cookies. Don't use Google Analytics -> No cookie law for you.

Except that every single site with the tools to help businesses comply says it applies to all cookies.

Fun fact, the EU excluded "third-party social plug-in content-sharing", which are used for more tracking than any of the other cookies.
