I think in that case the copyright infringement would be the uploader rather than YouTube, but IANAL.

There are CC-By-SA works uploaded to youtube by google employees while at work.

Only if the employee is doing the upload as a function of their job can google have any liability. In any other circumstance google s protected by the safe harbor provisions of the law.

I think you have a good case, if the copyright holder/author is also someone else than the uploader.
